Acting in good faith on false information, the variance request arose largely from a fictitious letter by a fictitious person who apparently sent the l&&ter as a hoax. Upon learing for the first time at the public hearing that this home had been occupied for nine years or more, and prior to zoning, the Zoning Administrator properly ruled that the Board of Zoning Appeals had no need to hear your petition. The County is refunding your twenty dollars for the application that you made. For purposes of this section only, the term "structures" shall not be deemed to include on-site signs for sale or rental of property, shelters designed and used by school children travelling to and from school, or structures, other than signs, for which no permit is required under the Uniform Statewide Building Code. Section 10-5-1 Expansion and Enlargement: The use of any building or structure shall conform to the provisions of this ordinance relating to the district in which the same is situated whenever such building or structure is enlarged, extended, reconstructed, or structurally altered. In converting a non-conforming structure and use to a conforming structure and use (garage to a single family residence in an A-1 zone) , the applicant, in so doing, must meet the ordinance requirement of a conforming use. (Section 10-5-1) In order for the applicant to do this, he has requested the Board's relief from Section 2-3 (front setback) claiming that the County's strict enforcement of the ordinance creates a demonstrable hardship. STAFF COMMENT Applicant applied for a building permit to convert the garage to a single- family residence. The Building Official approved the building plan for conversion pursuant to the Building Code. The applicant was soon there- after informed of the zoning setback problem and directed to apply for a variance before the Zoning Administrator would allow a building permit to be issued by the Building Official. The conversion of a non-conforming use to a conforming use is favored by the Planning Staff in that it promotes the intent of the ordinance. The staff recommends approval.
