EXISTING ACTIVITY New Subdivision ZONING ORDINANCE REQUIREMENTS Section 5-5-2 Rear: Each main structure shall have a rear yard of thirty-five (35) feet or more. Section 5-7-1 Special Provisions for Corner Lots: Of the two sides of a corner lot the front shall be deemed to be the shortest of the two sides fronting on streets. VARIANCE REQUESTED Applicant request a 15 foot variance from the 35 foot rear setback requirement. The front of the house faces Woodmont Drive (See Plat # -, ) . The applicant's hardship as claimed is a misunderstanding of the corner lot provision of section 5-7-1 in that confusion arose over what was a side or rear yard for a corner lot. STAFF COMMENT The Building Permit (#77-350NR) was lawfully issued by the Building Official and Zoning Administrator of the Inspections Department. As approved (See attachment #3(-/ ) the site plan clearly indicated how the house must be set in order to meet all the required setbacks. The contractor apparently turned the house 90 degrees without authorization and in so doing created a rear setback violation. No certificate of occupancy may be issued to the home owner when a zoning violation exists. (Judge Berry of the Albemarle Circuit Court has previously ruled. on the corner lot provisions of the County Zoning Ordinance stating that in the event of disagreement the front of the house on a corner lot shall be that side which the front door faces. ( This is a deviation from section 5-7-1. ) The court's ruling may possibly be of assistance to the `Board in deciding whether a variance may be granted.) Please show cause why this office should direct the Building Official to not issue a certificate of occupancy until such time the violation is corrected or the Board of Zoning Appeals, upon application, chooses to grant you a variance.
