ZONING ORDINANCE REQUIREMENTS
Section 5-5-2 Rear: Each main structure shall have a rear yard of thirty-five
(35) feet or more.
Section 5-7-1 Special Provisions for Corner Lots: Of the two sides of a corner
lot the front shall be deemed to be the shortest of the two sides fronting
on streets.
VARIANCE REQUESTED
Applicant request a 15 foot variance from the 35 foot rear setback requirement.
The front of the house faces Woodmont Drive (See Plat # -, ) . The applicant's
hardship as claimed is a misunderstanding of the corner lot provision of
section 5-7-1 in that confusion arose over what was a side or rear yard for
a corner lot.
STAFF COMMENT
The Building Permit (#77-350NR) was lawfully issued by the Building Official and
Zoning Administrator of the Inspections Department. As approved (See attachment #3(-/ )
the site plan clearly indicated how the house must be set in order to meet all the
required setbacks. The contractor apparently turned the house 90 degrees
without authorization and in so doing created a rear setback violation. No
certificate of occupancy may be issued to the home owner when a zoning violation
exists.
(Judge Berry of the Albemarle Circuit Court has previously ruled. on the corner lot
provisions of the County Zoning Ordinance stating that in the event of disagreement
the front of the house on a corner lot shall be that side which the front door
faces. ( This is a deviation from section 5-7-1. ) The court's ruling may
possibly be of assistance to the `Board in deciding whether a variance may be
granted.)
If the Board should choose to approve the variance, the staff recommend no
conditions.

ZONING ADMINISTRATOR'S NOTE TO THE BOARD NOT TO BE READ TO THE PUBLIC:
In the event of approval, the Zoning Administrator urges the Board to
inform the applicant that future violations of this nature can constitute
a self-imposed hardship which can lawfully be a ground for the Board
to not grant a variance. The applicant, a contractor, is under a lawful
obligation to be informed of the ordinance requirement and to follow his
approved building permit site plan without deviation.

Your phone call of yesterday was most appreciated concerning
notice to all adjoining landowners who may be interested in the
variance applications by Mr. Thomas Forloines and the fact the same
were being heard before the Board of Zoning Appeals on August 10, 1977.
The records have been researched again by the clerical staff and
Mrs. Crenshaw among others had not yet been notified. Proper notices within
the appropriate legal time frame have now been sent to all adjacent property
owners and therefore the public hearing shall proceed. Your vigilance
and assistance were very helpful and I wish to express my gratitude.

Zoning violation
Dear Gentlemen:
This office has been informed that the single-family residence under
this permit violates the rear setback requirement of 35 feet by 15 feet,
(Section*two The building permit application showed a site plan for positioning
the house in a manner to allow for meeting all zoning ordinance setbacks
and such was approved by the zoning inspector and the Zoning Administrator.
Please show cause why this office should direct the Building Official
to not issue a certificate of occupancy until such time the violation
is corrected or the Board of Zoning Appeals, upon application, chooses to
grant you a variance. Please also include in your response a proper
reason why the home was turned and constructed in violation of the approved
site plan.
