Please find enclosed the following:
1) Copy of the Board of Zoning Appeals minutes reciting
the action taken by the Board on September 13, 1977.
(Note the one year limitation)
2) Copy of your variance application.
3) Copy of the M-2 Zone sign regulations.
4) Copy of the setback required for all structures in
the M-2 Zone. (A sign is a structure.)
5) Copy of Sign Permit (No record of permit)
6) Copy of March 6, 1978,1etter requesting you you to correct
a sign violation and a variance violation. (This letter
came 7 months after the variance.)
The last item, considering the one year variance permit that you
had, was issued in error. The sign is presently unlawful since the
variance was temporary and has expired.
T recommend a re-application for a variance before March 26, 1979,
if you desire to keep the sign in its present location.
The sign could be placed at your proposed Pyrofax site as long as
all regulations are met. If you meet the setback, no variance would be
required. You should check, if this is the choice, to make sure your
sign area and Pyrofax do not exceed 100 square feet.

Mr. .Farmcr sta.,ed that the deck would be the closest to the- : -
gear property line. He further stated that Mr. Fishback would like
a
some flexibility in the rear yard to move the deck back as close as
10 feet to property line.
It was noted that a letter had been received from Mr. & Mrs. W. W.
Syler stating their approval of the request, • }

Mr. Dick read the letter to the Board members at this time.
Present was Ms. Elizabeth Dinwiddie speaking on behalf of the request.
The public hearing was then closed so the Board could take action.
Mr. Smith made a motion to grant the variance without the staff condition.

Taylor Body Shop.
Mr. Doug Taylor was present.
Mr. Taylor stated that he could meet the setback on 29 North but could
not-on the access road. Mr. Taylor further stated that he would like to
make his existing sign "two-faced". •
Mr. Smith made a motion to approve the variance for the access road for
-- one year, or lesser time until Mr. Gelletly erects a sign for the businesses
in the Industrial Park. -

15A-7-5 Temporary Event Signs: Provided: (a) not more than
sixteen (16) square feet in area; (b) not more than
two (2) on any lot or premises.
15A-7-6 Public, No Trespassing, Hunting, Fishing, and Political
Signs.
15A-7-7 Location Signs : Provided: (a) if illuminated, no moving,.
flashing, blinking or color changing or neon illumination
or lighting; (b) the area of the sign shall not exceed
one hundred (100) square feet; (c) no portion of the
sign shall be greater than thirty (30) feet from ground
level; (d) no more than six (6) such signs directing
attention to any one (1) establishment is permitted;
(e) provided further that no such sign shall be closer
to another such sign than one thousand five hundred
(1,500) feet on the same side of a right-of-way.
15A-7-8 Auction Signs: Provided: (a) not more than thirty-
two (32) square feet in area; (b) not more than one
(1) on any lot or premises.
M-2 Manufacturing
15A-8-1 Business Signs: Free-Standing or Projecting Signs:
Provided: (a) if illuminated, no moving, flashing,
blinking, color changing or exposed, bare or uncovered
neon illumination or lighting; (b) the aggregate area
of such signs shall not exceed one hundred (100) square
feet; (c) no portion of such sign shall be greater than
thirty (30) feet from ground level or the eave line of
the roof of the main building located on the premises
upon which such sign is erected, whichever is greater;
(d) no more than two (2) free-standing signs on any one
(1) lot or premises; (e) no more than three (3) pro-
jecting signs.
15A-8-2 Business Signs: Wall: Provided: (a) if illuminated,
no moving, flashing, blinking, color changing, or ex-
posed, bare or uncovered neon illumination, or light-
ing; (b) the aggregate area of all such signs shall not
exceed three hundred (300) square feet; (c) no portion
of such sign shall be greater than thirty (30) feet from
ground level or the eave line of the roof of the main
building located on the premises upon which such sign
is erected, whichever is greater.
15A-8-2. 1 Business Signs : Roof : (a) sign shall in no manner be
illuminated; (b) the aggregate area of all signs for
any establishment shall not exceed one hundred (100)
square feet; (c) sign shall be in vertical plane; (d)
no portion of sign shall exceed thirt.v (30) feet in

15A-9 • ' Signs.
15A-9-1 Removal of Signs: Whenever a sign becomes structurally
unsafe or endangers the safety of a structure or pre-
mises or the public, or is erected or maintained in
violation of this Ordinance, the Zoning Administrator
shall order such sign to be made safe or comply with '
this Ordinance, as the case may be, or be removed.
Such order shall be sent by registered mail and shall
be complied with within twelve (12) days from the date
of mailing_ said order by the persons owning or respon-
sible for the sign. Failure to comply shall consti-
tute grounds for the Zoning Administrator to have the
sign removed, and the cost thereof shall be added to
any fine imposed for violation under this Ordinance.

9-4 SETBACK REGULATIONS
All structures except signs advertising sale or rent
of the property shall be located fifty (50) feet or
more from any street right-of-way.
9-5 YARD REGULATIONS (Amended 3-29-78)
For permitted uses, the minimum side and rear yards
adjoining or adjacent to a residential or agricul-
tural district shall be one hundred (100) feet or
more. Off-street parking shall be in accordance
with the provisions contained herein.
9-6 HEIGHT REGULATIONS
Buildings may be erected up to a height of sixty (60)
feet. For buildings over sixty (60) feet in height,
approval shall be obtained from the administrator.
Chimneys, flues, cooling towers, flag poles, radio or
communication towers or their accessory facilities,
not normally occupied by workmen, are excluded from
this limitation. Parapet walls are permitted up to
. four (4) feet above the limited height of the building
on which the walls rest.
`' . 9-7 COVERAGE REGULATIONS
Buildings or groups of buildings with their accessory
buildings may cover up to seventy percent (70%) of the
area of the lot.

ZONING ORDINANCE REQUIREMENT
Setback Regulations: All structures except signs advertising sale or
rent of the property shall be located fifty (50) feet or more from
any street right-of-way.
VARIANCE REQUESTED
Applicant seeks variance of 40 ft. from Route 29 right-of-way (10 foot
setback from Rt. 29) and a 35 feet variance from the access road (15
foot setback) to place a business free-standing sign. Applicant
claims no sight identification distance from route 29, southbound
lane. Applicant claims topographic conditions in the south bound
lane that affect identification of the sign.
STAFF COMMENT
Absent a showing of a demonstrable hardship, staff recommends
denial. The pyrofax sign meets the setback although the
Hall & Taylor Shop is located much farther off the road than
the pyrofax building. The Board should consider the fact that other
businesses will locate in this park. If the Board should choose
to approve the variance, the staff recommends no conditions.
