(Note the one year limitation) 2) Copy of your variance application. 3) Copy of the M-2 Zone sign regulations. 4) Copy of the setback required for all structures in the M-2 Zone. (A sign is a structure.) 5) Copy of Sign Permit (No record of permit) 6) Copy of March 6, 1978,1etter requesting you you to correct a sign violation and a variance violation. (This letter came 7 months after the variance.) The last item, considering the one year variance permit that you had, was issued in error. The sign is presently unlawful since the variance was temporary and has expired. T recommend a re-application for a variance before March 26, 1979, if you desire to keep the sign in its present location. The sign could be placed at your proposed Pyrofax site as long as all regulations are met. If you meet the setback, no variance would be required. You should check, if this is the choice, to make sure your sign area and Pyrofax do not exceed 100 square feet. ry Doug Taylor Page 2 March 2, 1979 Again, I apologize if for any reason, I caused you embarrassment at this office. He further stated that Mr. Fishback would like a some flexibility in the rear yard to move the deck back as close as 10 feet to property line. It was noted that a letter had been received from Mr. & Mrs. W. W. Syler stating their approval of the request, • } . E Mr. Dick read the letter to the Board members at this time. Present was Ms. Elizabeth Dinwiddie speaking on behalf of the request. The public hearing was then closed so the Board could take action. Mr. Smith made a motion to grant the variance without the staff condition. Mr. Bain seconded- the motion which carried-unanimously. Mr. Doug Taylor was present. Mr. Taylor stated that he could meet the setback on 29 North but could not-on the access road. Mr. Taylor further stated that he would like to make his existing sign "two-faced". • Mr. Smith made a motion to approve the variance for the access road for -- one year, or lesser time until Mr. Gelletly erects a sign for the businesses in the Industrial Park. - r { Mr. Bain seconded the motion, which carried unanimously. Such order shall be sent by registered mail and shall be complied with within twelve (12) days from the date of mailing_ said order by the persons owning or respon- sible for the sign. Failure to comply shall consti- tute grounds for the Zoning Administrator to have the sign removed, and the cost thereof shall be added to any fine imposed for violation under this Ordinance. 103 4' 9-4 SETBACK REGULATIONS All structures except signs advertising sale or rent of the property shall be located fifty (50) feet or more from any street right-of-way. 9-5 YARD REGULATIONS (Amended 3-29-78) For permitted uses, the minimum side and rear yards adjoining or adjacent to a residential or agricul- tural district shall be one hundred (100) feet or more. Off-street parking shall be in accordance with the provisions contained herein. 9-6 HEIGHT REGULATIONS Buildings may be erected up to a height of sixty (60) feet. For buildings over sixty (60) feet in height, approval shall be obtained from the administrator. Chimneys, flues, cooling towers, flag poles, radio or communication towers or their accessory facilities, not normally occupied by workmen, are excluded from this limitation. VARIANCE REQUESTED Applicant seeks variance of 40 ft. from Route 29 right-of-way (10 foot setback from Rt. 29) and a 35 feet variance from the access road (15 foot setback) to place a business free-standing sign. Applicant claims no sight identification distance from route 29, southbound lane. Applicant claims topographic conditions in the south bound lane that affect identification of the sign. STAFF COMMENT Absent a showing of a demonstrable hardship, staff recommends denial. The pyrofax sign meets the setback although the Hall & Taylor Shop is located much farther off the road than the pyrofax building. The Board should consider the fact that other businesses will locate in this park.
