VA-77-60 Interstate Electric (per agent Elmer B. Byers)

VARIANCE REQUESTED
The applicant was under the impression he had met the required
setback from the state right-of-way. The zoning inspector had
received information on the highway right-of-way from the
Highway Department prior to the setting of sign. He was informed
the right-of-way was 50 feet when in fact it was 80 feet. The
inspector has even encouraged additional footage of setback when
the sign was set in order to be safe. The wrong information
made the precaution futile although it has helped in minimizing
the setback violation. The applicant claims no self-imposed
hardship, but claims extraordinary circumstances.
ZONING ORDINANCE REQUIREMENT
Section 7-3 of the ordinance requires a setback of all structures
to be 30 feet or more.
STAFF COMMENT
The inspector and the applicant made a good faith effort. If the
Board chooses to approve the variance, the staff recommends the
following condition:
1) The sign be classed as a temporary non-conforming sign.
Restoration or a change in the sign exceeding 50% of the
value of the existing sign shall require that the sign be moved
to meet the zoning ordinance setback. (Reference section
15A-9-2 of the zoning ordinance. )
