Clearly, the sign was erected during Mr. Cotton's ownership, contrary to the sign provisions for the B-1 zone. (See attach- ment #1) A freestanding sign could be no larger than 100 square feet. By the calculations previously submitted, the existing • sign is approximately 134 square feet, give or take a few feet, and certainly is larger than the sign proposed in the letter to Mr. Cotton, of which a copy you gave this office. (Attachment #2) (Sign attachment #3) Therefore, the Zoning Administrator requests that you pro- cess a variance for the 1978 April agenda before the Board of Zoning Appeals by the deadline of March 27, 1978, or thereafter • the sign shall be treated as an unlawful sign, and I will be com- pelled to seek to have it removed as a violation of the sign or- dinance that has been outstanding for 6 years. Javor - Woodbrook Village Merchants Association Tax Map: 45C Parcel : 2 Zoning: B-1 Acreage: . 686 EXISTING ACTIVITY This site is located on the east of Rt. 29 north at the entrance of Woodbrook Subdivision. A shopping center exists on the property and a residential section is located to the east. An animal hospital is located on the opposite side of Rt. 29 north. PROPOSED VARIANCE The applicant seeks a variance of 65. 5 sauare feet in addition to the 100 square feet maximum size allowed for a freestanding business sign. (Section 15A-6-1) Applicant wishes to improve identity of the individual stores within the shopping center. ZONING ORDINANCE REQUIREMENT The Albemarle County Zoning Ordinance requires that freestanding business signs be limited to a 100 square foot maximum area in size and no more than two signs on any one parcel . STAFF RECOMMENDATION The advertising need of local shopping center merchants may be necessary. However, the existing sign by county records is without a recorded permit and by our research unlawful in that it was erected after the zoning ordinance was adopted and exceeds 100 square feet without a known variance. Staff recommends a permit be filed and that some variance be granted to the present sign which is 135 square feet or possibly greater if more exacting dimensions are given by the applicant. Whether or not additional area for the proposed new sign should be granted is within the discretion of the Board of Zoning Appeals as in needed variance for the present sign.
