On October 17, 1974, the existing owner of the land and building in question was David A. Smith. Mr. Smith sought to have the building used for commercial activity. A site plan with conditions was approved by the County Planning Commission on September 16, 1974. (letter attached.) Conditions number 1 and 3 have not been met. In the event Mr. Cochran, the present owner, is unaware of this requirement, this letter and information is for his review and action. In addition, the present tenant, Mr. Henry Maresi, was granted a sign setback variance if he or the landowner complied with the site plan. Mr. Maresi agreed to put down the railroad ties in order to be granted a variance. (See action letter of November 10, 1977.) To date, the site plan requirement of parking and landscaping have not been met. The idea of marking the fence rail with paint or tape does not comply with the Planning Commission require- ment of 7 railroad ties. Only the Planning Commission could waive this re- quirement. The Zoning Administrator hereby requests that the site plan be complied with before January 30, 1978. I trust that this simple matter can be handled expediently by all concerned. If you wish to see the site plan, need assistance, or have any questions, please contact the Zoning Administrator. An antique shop is situated just west of this property and the Crozet Moose Lodge which is on the east side of said property. The only other existing activity in the vicinity is several hundred yards away on the opposite side of route 250. The property on which the variance is being applied for is presently being used for the retail sale of wood stoves . PROPOSED VARIANCE Applicant requests a variance of 147 feet from the required 150 foot setback for a free-standing business sign. (See VA-75-09 Country Antiques for previous variance of same nature. ) ZONING ORDINANCE REQUIREMENT The Albemarle County Zoning Ordinance requires that free-standing business signs be erected no closer than 150 feet to any street, road or access easement in accordance with Article 18-3-1. The poles that were erected for the sign described in VA-75-09 remain in existence. The applicant claims that it would be an additional financial burden to change the sign location. Also, if the 150 ' setback is required the sign would have to be erected approximately 100 feet to the rear of the business. STAFF RECOMMENDATIONS Staff noted the sign is already erected and that a permit application has been made but not approved. The staff recommends the possible use of a wall or roof sign in which event this variance should be denied.
