EXISTING ACTIVITY
The present lot on route 250 west contains the 1740 Antique Shop. To the
west is located the Chinese Food Restaurant and to the east, vacant land.
VARIANCE REQUESTED
Applicant has purchased a very old historic log cabin which he is going to
restore and place on his property for storage use. To place the cabin on
the particular spot he wishes, the applicant needs a variance of 65' from
the required 150' setback of the scenic highway or a building setback line
of 85' . The applicant claims a demonstrable hardship of not being able to
locate the cabin elsewhere without disturbing existing and proposed parking.
The applicant proposes the restoration of the log cabin to be in keeping
with the scenic highway.
ZONING ORDINANCE REQUIREMENT
Article 18-3-1 of the zoning ordinance requires all structures to have a
minimum setback of 150 feet.
STAFF COMMENT
Unless the applicant can show a demonstrable hardship, it appears the accessory
building could meet the required setback at another location and therefore
the staff would not recommend approval.
However, the front property line has existing trees for adequate screening as
well as the side property. If the Board chooses to approve the variance, the
staff recommends the following conditions:
1) The log cabin be maintained.
2) If in the event the cabin falls to a state of being in disrepair the
Zoning Administrator on notice to the owner to maintain the building
and such is not accomplished within 30 days of such notice, that the
variance be revoked and not reinstated without a formal petition to
the Board of Zoning Appeals.
3) Building Official certification that the structure meets the building
code.
4) No retail sales within the cabin or other accessory building without
approved site plan and the Building Official's approval.
5) No outside storage.
