LAND SURVEYORS A PROFESSIONAL CORPORATION 914 MONTICELLO ROAD CHARLOTTESVILLE, VIRGINIA 22901 December 13, 1977 Mr. Benjamin Dick Zoning Administrator County of Albemarle Dear Ben, I would like to submit the following background information in reference to the application for a variance as to lot size for Lot 11, Lewis Hill West: 1. A tract of land supposedly containing 30. 40 acres was surveyed (by another firm) on April 27, 1972. The rear boundary of this tract was shown as 2 straight lines, with a stream following these 2 straight lines. 2. Our client, Mr. Walter Cushman, purchased this tract of land and re- quested that we compute the division of this tract into 2 acre lots based on the prior boundary survey. In August 1974 we prepared a subdivision of the property into fourteen 2 acre lots. The subdivision of these lots was approved by the Planning Commission on November 13, 1975 and December 6, 1976. 3. Lots were sold from time to time based on the subdivision plat which we prepared from the 1972 boundary survey. On October 7, 1977 a physical survey was made by another firm on Lot 11, and at that time it was found that the stream did not follow the straight lines along the rear boundary as originally shown on the plat dated April 27, 1972, and that the acreage com- puted to the actual location of the stream was 1.923 acres rather than 2. 16 acres. 4. We were notified of this discrepancy and attempted to resolve the problem in several ways. First, a resurvey was made of the outside boundaries of the tract which revealed that it contained 30. 24 acres rather than 30.40 acres which was about equal to the shortage found in Lot 11. Second, an attempt was made to acquire additional square footage from the J. Howard Smith tract; this was unsuccessful. Third, we attempted to redivide Lots 10, 11 and 12 by reapportioning square footage among these 3 lots to make each lot at least 2 acres in area, but this was not possible due to the fact that lots 10 and 12 had already been sold and thereby would require the Page -2- Mr. Benjamin Dick Re: Lot 11, Lewis Hill West December 13, 1977 consent of not only the owners of the lots, but also the trustees, bondholders, mortgage and insurance lenders. S. After exhausting all of the other alternatives, an application was filed with the BZA for a variance based on hardship which resulted from no other relief being available. Three plats are attached for your information. Plat #1 shows the boundary survey upon which that subdivision was based. Plat #2 is a composite plat showing the division of the tract into 14 lots. Renoe Tax Map: 58 Parcel: 81F Zoned: A-1 Acreage: 1.923 EXISTING ACTIVITY Single Family Residence VARIANCE REQUESTED The applicant requests relief from the A-1 Section 2-2 of the Zoning Ordinance that requires a minimum of two (2) acres per single family dwelling to allow for a lot in the Lewis Hill Subdivision, Lot 11, Ivy Area, to be 1.923 acres. ZONING ORDINANCE REQUIREMENT The A-1 Section 2-2 requires a minimum of two (2) acres per single family dwelling. STAFF RECOMMENDATIONS Pursuant to Virginia Code Annotated, Section 15. 1-495, the Board of Zoning Appeals has jurisdiction to grant within their purview a variance for "other extraordinary situation or condition of such piece of property". Between two surveyors a discrepancy arose upon separate surveys revealing a different rear property line so as to reduce the required 2 acres to 1.923 acres. The Planning Commission approved the subdivision plat for 2.16 acres on this particular lot (attached) . The plat has been recorded. New plats of the surveyor's have been worked up. Staff consulted with the County Attorney's office on the state statute's parameters for the Board and in that process were informed of a recent case in Judge Fry's Court of Louisa County. The case was similar in cir- cumstances and the court reversed the Board of Zoning Appeals denial of the variance as arbitrary and capricious. Therefore, staff feels this is an extraordinary situation and recommends approval since the house is already built and property rights have been acquired.
