VARIANCE REQUESTED
Applicant requests a variance of 11 feet from the required 30 foot setback
for a freestanding business sign in a B-1 zone. Article 7-3 of the Albemarle
County Zoning Ordinance. This variance is requested because applicant states
the Department of Highways gave the applicant the wrong right-of-way width
before erecting the sign. The applicant has installed the sign pursuant to the
building and electrical codes as a freestanding sign. Necessary permits were
issued except the sign permit was disapproved.
ZONING ORDINANCE REQUIREMENTS
Section 7-3 requires all structures, except signs advertising sale or rent of
property, shall be located thirty (30) feet or more from any street right-of-way.
STAFF RECOMMENDATIONS
The applicant chose to rely on the Highway Department information. A demonstrable
hardship or extraordinary conditions must be shown by the application. Staff spoke
with the Highway Department and while acknowledging the applicant may have gotten
the wrong information, although they have no record that this information was given,
the applicant had the benefit of a very recent survey that clearly delineated the
right-of-way line and property lines. The applicant should have double checked
with the Zoning Administrator since the setback is a county requirement . Staff
therefore recommends denial of this variance. If the Board should choose to grant
the variance, the staff recommends the following conditions:
a) That the variance be temporary and the sign removed within 12 months.
b) Any alteration, change, or a new sign installed shall meet the setback
requirement.
