Dear Ben:
Enclosed is the information that I have sought
from Talley Neon and Advertising Company setting forth the
work they performed upon on Pantops Mountain back in the
latter part of 1969 and early 1970 pursuant to the sign
permit signed by John Humphrey for the signs to be placed
on Jim Price ' s business property. I enclose a picture show-
ing the signs as taken by Talley Signs , a copy of the work
order of Talley Signs , a copy of the sign permit signed by
John Humphrey and a copy of the work order of Allied Concrete
for delivery of materials to the job site dated 1/27/70 .
It appears from the evidence submitted herein
that the signs that are presently located at Jim Price Chev-
rolet on Pantops Mountain are the same signs that were put
in place by Talley Sign Company pursuant to the sign permit
granted by Albemarle County in December , 1969 .
Please let me hear from you at your earliest con-
venience regarding your response to the information submit-
ted herewith and any questions or additional information
you may have of me. After you have had a chance to digest
this information , I would appreciate the opportunity to have
your comments .

The next item to come before the Board was Bill Edwards Oldsmobile, Inc. ,
VA-77-38.
VA-77-38 Bill Edwards Oldsmobile, Inc. ; applicant requests
90 square foot variance from Section 15A-6-1 of Zoning
Ordinance to allow two freestanding signs to be 195 aggregate
square feet.
Mr. Edwards was present to speak to his variance application.
Mr. Heath read the staff report as well as a letter for Mr. Edwards
dated May 26, 1977 requesting a rehearing to consider new evidence.
Mr. Edwards was present to speak to this variance application. He
presented to the Board two (2) letters from Mr. A.H. Wangbechler
of GM-DI Leasing Corporation dated May 4 and May 17, 1977 which
give the cost and time required to produce, ship and install another
Oldsmobile Product sign.
There was some discussion of two separate "product" signs;
requesting to locate the GM at the north end of the property and the •

Honda sign at the south end of the property.
Mr. Smith questioned the variance needed for each sign. •

Mr. Edwards stated that the Board had previously granted him
under VA-77-22, a temporary variance of 88 feet and a permanent variance
of 35 feet.
Mr. Kennedy asked what the possibility would be of placing
both signs on the same pole. Mr. Smith stated he would like to see
the signs have separate variances.
Mr. Payne, Assistant County Attorney, stated that he suggested
rewording condition #2 in staff report to read "variance relates only
to these signs". Mr. Payne stated that this would prohibit Mr.
Edwards from adding to the sign in question and if replaced it would •
require replacement of a smaller sign.
Mr. Smith moved to approve the variance with the following
condition:
1) That the sign not' exceed 30 feet height;
2) and if the Honda sign is ever removed that
the variance be reduced.
Mr. Payne advised Mr. Smith as to the language of the
conditions and Mr. Smith's final motion was as follows:
To approve the variance request of 86 ft. with the following
conditions:
1) That the sign not exceed 30 feet height;
2) that the variance be limited to the existing
GM and Honda signs and replacement of these signs
shall comply with the terms of the Ordinance.
Mr. Roberson seconded the motion which carried unanimously.

The last matter to come before the Board of Zoning Appeals was
VA-77-39, W.J. Kirtley, Jr.
Mr. Heath read the staff report.
VA-77-39 W.J. Kirtley, Jr. ; applicant requests variance of
120 feet from Section 18-3-1, Scenic Highway Designation,
to allow proposed buildings to be located 30 feet from
right-of-way of Rt. 250.
Mr. Kirtley, owner and Mr. Stuart Carwile, Attorney at Law, were
both present to speak to this application.
Mr. Kirtley stated that his property was rather unique because
of the M-1 Zoning. He stated further that at present there was 18,000
ft. of warehouse building at the rear of this property which is serviced
by the C & 0 Railroad. The property has been graded and needs very little
in order to build on. Mr. Kirtley stated that rather than construct another
warehouse or expansion of the existing warehouse on the site he is
proposing to place building, as close to the road as possible, which

Gentlemen:
I would like to request that you not grant Variance
Appeal # VA-77-73 for an additional 129 square feet of free—
standing business aignoga° applied for by Henry J. and Patricia
M. Price.
As a resident of Westmoreland Subdivision, I feel that if
this variance were granted it would further deterimrate the
area of Route 29N directly opposite the entrance to our sub—
division, Carrobrook and Northfields.
Bettor Living Furniture Company is now operating next to
the Price property with an attractive facility and a very
minimum of aignago" They seem to be getting along pretty well
that way, and the nearby residents are not unduly afflicted.
if , however, you grant the Prices their variance, Better Living
and others will be in to see you the next day, and it udn ' t be
easy for you to find a reason not to grant them the same
privilege. Since it is obviously not necessary for businesses
there to have greater than allowable signageg why not do the
residents, passersby and yourselves a favor and turn down the
Prices ' request.

Vacant lot with site plan approval for Chevrolet Dealership
VARIANCE REQUESTED
Applicant requests a variance from section 15A-6-1 to allow an additional
129 square feet for two free standing business signs or an aggregate area
of 229 square feet. Applicant claims hardship of having the present signs
by a lawful county permit but not being able to transfer them to another site
within the county. The non-transferability the applicant feels imposes a
hardship of inadequate identification and a financial hardship for new signs.
ZONING ORDINANCE REQUIREMENT
Section 15A-6-1 requires that no more than 2 freestanding signs may be erected
on any legal parcel in a B-1 zone and the aggregate area may not exceed 100
square feet.
STAFF COMMENT
Staff notes that applicant may have sufficient time to have General Motors build
a sign in conformance with the present zoning ordinance. (see attachments)
Moreover, the county contemplates having a new sign ordinance by the end of the
summer that may possibly allow the present signs. For these reasons, staff
recommends denial of the variance. If the Board, however, chooses to grant the
variance, staff recommends:
1. A temporary variance of one year at which time compliance with the sign
ordinance must be made by the applicant.
2. One sign rather than two.

Re: Jim Price Chevrolet Sign
Dear Ed:
The Deputy County Attorney, Fred Payne, and the Zoning Administrator
have conferred together on the legal status of the existing Jim Price
Chevrolet sign. This letter will serve as an advisory one in assisting
you and your client's quest in finding the appropriate zoning procedures
with which to proceed to gain necessary permits and approvals for proposed
signs.
The existing sign is lawful under a properly issued permit from the
county. As you know, however, the ordinance has been amended to be more
restrictive and the present ordinance provisions would technically class
the existing sign as a "non-conforming structure" .
Non-conforming structures may continue on the owner's parcel of the
district on which it was placed unless a two year lapse of disuse occurs
in which event the structure must meet the zoning ordinance requirements or
be removed. It is clear, in our opinion, that a sign permit only runs with
the land upon which it applied.
The Zoning Administrator concurs with the Deputy County Attorney's legal
research which found ample authority to assure the county and the Zoning
Administrator that the lawful permit issued in 1969 does not entitle the
holder to move the existing sign to a different legal parcel. To allow this
otherwise would fly in the face of the legislative intent and letter of the
present local zoning laws on signs.
Therefore, in view of the large size of the existing signs, the best
course Jim Price could pursue, in my opinion, is to proceed while he has
ample time to request that General Motors make him signs that comply with
the present zoning ordinance provisions. (Freestanding, roof, or wall signs.)
A wall and freestanding sign would give him lawfully up to 300 square feet
of advertisement. •

He might also consider the fact that the Sign Commission is working
very hard on a new sign ordinance that may accommodate his desires moreso
than the present ordinance. The adoption date of this ordinance, however,
is presently unknown due to the complexity of the endeavor. The only other
alternative is to seek a variance through the proper zoning application
process.

Dear Ben:
I am in receipt of your letter of November 3, in which you
inquire as to the legality of a change in location of an existing
sign on the property of Jim Price Chevrolet on Pantops Mountain.
I understand the facts to be as follows . In 1969, a permit was
lawfully issued for this sign pursuant to the zoning ordinance
as it existed at that time. Shortly thereafter, in January of
1970 , the sign was erected on the Pantops site and has since then
been maintained in substantially the same form. Subsequently, the
ordinance was amended in such a way that a sign such as this could
no longer be erected in the County. The applicant now desires
to relocate his business to a location on Route 29 North and wishes
to relocate the sign to his new location. The question presented
in your letter is whether this sign may be relocated consistent with
the ordinance. I understand that your opinion is that it cannot.
In my opinion, your view of the situation is substantially
correct. I believe that this sign is now non-conforming under the
terms of the ordinance. See Zoning Ordinance, Sections 10-1-1 and
10-4 . In other words , the fact that the sign was originally built
pursuant to a lawful permit has established a vested right in the
owner to maintain it in its present condition, but the relevant
amendments to the ordinance have made it non-conforming. It would
appear that the consistent position of the Courts which have dealt
with this issue has been that such structures cannot be moved to a
different location, even one with similar zoning, without conforming
to the now existing provisions of the ordinance. See 1 Anderson,
American Law of Zoning, Section 6 . 34 , page 383; Triangle Outdoor
Advertising Company v. Chaddick, 6 Ill. App. 3d, 1058 , 286 N.E. 2d
610 (1972) ; See also, Zoning Ordinance, Section 10-5-1. Therefore,
it is my opinion that the sign in question cannot lawfully be moved

to a new location in the County unless it can be made to conform
to the provisions of the ordinance applicable at the new location.

Our present volume of orders as well as our production capacity, indicates ,
that approximately five months time will be required to complete the project.
We advise you of this appologetically. More than fifty percent of our present
orders are "No. 1 Priority" . Obviously, all cannot be produced first. We
attempt to complete each in the order in which they are received.
However, we assure you that every effort would be made to improve on the
schedule in the event that the smaller sign is ordered.

This letter will confirm our phone discussion of April 29 , 1977 concerning
the proposed changes in sign code restrictions and the resulting effect on
your present identification.
The Oldsmobile Product Sign presently installed at your facilities is a P137
model. Its dimensions are approximately 11' x 11' x 31 feet in height. At
the time of its installation in early 1971 the monthly lease rate in effect for
that sign was $60. 00. (The current rate for a new sign of this size would
be $119. 5 0 per month)
We regret to advise you that if it should become necessary to remove and
return ship the present sign due to revised sign code enforcement the expense
to Edwards Oldsmobile_would appr-o i-maie-$_6_.,Q00. 00�
In addition to the above expense a new smaller product sign, such as a 9' x 9'
model 28' in height, will bear a monthly lease rate of $77. 50. Unfortunately,
$17. 50 more than your present rate on a larger sign.
