EXISTING ACTIVITY
Vacant lot. Area in question is rural and the adjoining lot is also
owned by the applicant. (see plat)
VARIANCE REQUESTED
Relief from section 2-5-1 to allow a variance from the side yard setback
(25 feet) to position a single family residence to be 16 feet from the north-
west side yard and 33 feet from the southeast side yard. Applicant claims
the hardship of his unusual narrow lot size, the desire to place his house
at the best geographical location and if he centered the house, he would not
be able to meet either side yard setback due to the size of the applicant's
house. He can at least meet one side yard setback.
ZONING ORDINANCE REQUIREMENT
Section 2-5-1 requires minimum sideyard for each main structure shall be
twenty-five (25) feet or more.
STAFF RECOMMENDATION
The objections of lot 6 owner, if any, should have weight and would necessitate
the staff to recommend denial of the variance as requested by the applicant
since the location of the house could be shifted toward lot 8 which is owned
by the applicant. The applicant could combine his two lots and meet all set-
backs. This is a lot of record prior to zoning.
If the Board chooses to grant the variance as applied for, the staff recommends
two conditions.
a) No further expansion of the house to the side yard related to the
variance.
b) The variance be noted on the recorded plat and certification that
recordation of the variance has been made and the same forwarded to
the Zoning Administrator for county records.
