VARIANCE REQUESTED
Applicant requests relief from section 2-3 to allow a variance of 9 feet from
the from yard setback and relief from section 2-5-1 to allow a variance of 4
feet from the side yard setback. Applicant claims extraordinary circumstances
based on an inadvertent error by contractor and owner as to determining a proper
setback which because of this zoning violation a closing and mortgage agreement
cannot be met.
ZONING ORDINANCE REQUIREMENT
Section 2-3 requires all structures shall be located a minimum of seventy-five
(75) feet from any street, road , or access easement.
Section 2-5-1 requires the minimum side yard for each main structure shall be
twenty-five (25) feet or more.
STAFF RECOMMENDATION
For the record, staff feels the mistake was not due to any zoning inspector's
error since the inspector relied on the stake out of lines by the owner. If
the Board chooses to grant the variance on a showing of extraordinary circum-
stances, staff recommends the following conditions:
a) No expansion of the home forward of the existing front building line
or to the side yard area as such would relate to this variance.
b) The variance and these conditions be noted on the plat and recorded
in the clerk's office with a copy of certification of the recordation
sent to the Zoning Administrator for this county file.
