many years; each residence is served by existing well and septic tank. Property was
devised to above owners by their father (WB 44 p. 99), so that each of them might have
a residence. Partition is desired by the owners so that each may sotey own and maintain
one house and her share of the land. No change in use is to be made.

Existing Activity
(See Plat) Two existing single family residences on the south
side of Georgetown Road, Route 656. The residences are presently
deemed on 1 legal parcel.
Proposed Variance
Applicants seek to create separate lots by subdivision. Both
houses are being served by existing septic systems and wells .
Applicants seek a variance of 19,093 square feet from the
required 60,000 square feet for proposed parcel A and B. The
hardship claimed, as understood by the Zoning Administrator,
is for each lady to have her own residence and property lines .
The land is presently held jointly under a probated will .
Zoning Ordinance Requirement
Section 4-2-3 category states : residential developments served
by neither a central sewer system nor a central water supply
shall provide a minimum area of sixty thousand square feet per
dwelling unit .
Staff Cotutuent
Staff is of the opinion that these applicants must show a
demonstrable hardship to the Board. The Planning Staff
reports that the Albemarle Service Authority has expended
considerable funds to provide public water and sewer due
to problems that have existed at Hessian Hills and the
surrounding area. Connection to either water or sewer
would allow this subdivision to be entirely lawful under
the ordinance without the need of a variance.
If the Board chooses to approve the variance, staff recommends
the following condition to be noted on the recorded plats and
certification of the same forwarded to the Zoning Administrator
for County files .
a) Bona Fide sale of the lot will require a water or
sewer connection or both in order to conform with the
Zoning Ordinance before a certificate of occupancy shall
be issued or, in the event of depletion of the present
well, a water hook-up shall be required.
