Existing Activity
Original existing house is to the left of the entrance drive and animal
shed to the right of parcel 5B1 and second residence located at the end
of the road on parcel 6B in relationship to parcel 5-B in question.
Variance Requested
Applicant ask for a 12 foot variance from section 2-5-1 to allow a side
yard setback to be 13 feet. Applicant proposes a division of the property
as shown by placing a proposed side property line along the existing fence
but in so doing this would need a variance for him to retain ownership of
as much pasture as possible and the storage shed. The applicant seeks by
this proposed division not to change the geographical location of his
existing entrance to his residence.
Zoning Ordinance Requirement
Section 2-5-1 requires minimum side yard setback for each main structure
shall be twenty-five (25) feet or more.
Staff Recommendation
The staff recommends disapproval of this proposed variance unless the
applicant can demonstrate under the Virginia Code a hardship or other
extraordinary circumstances that would prevent him from dividing the
land in such a manner as to meet all required setbacks. On the evidence
presented to the file to this date, staff sees no hardship involved and
feels a property line could be drawn that would allow the applicant to
meet all the required setbacks in the division of his land.
