Applicant seeks relief from section 2-3 of the Albemarle County Zoning
Ordinance to allow a single family residence to be located 65 feet from
the road right-of-way rather than the 75 foot requirement. (10 foot
variance)
Zoning Ordinance Requirement
Article 2, section 2-3 states all structures shall be located a minimum of
seventy-five (75) feet from any street, road, or access easement.
Staff Comment
The applicant claims the hardship that the house location arose over a
misunderstanding between the owner and the contractor. The footings
inspection covered the main structure foundation and not the porch added
to the house. (Note: At the time of the footings, the cross training
of building inspectors to check zoning setbacks had not yet occurred in the
County.) The house is 2 feet too close and the porch 7 feet.
If the Board chooses to grant the variance, the staff recommends no condi-
tions of approval.
