Ward Mobile Homes Tax Map: 32 Parcel: 5E & 5F Zoned: M-1 Acreage: 11.74 acres Existing Activity Vacant Lot Proposed Variance Applicant seeks relief from Section 8-4 of the Albemarle County Zoning Ordinance to allow a free-standing sign to be located 30 feet from the road right-of-way rather than the required 50-foot setback. The sign was installed according to their approved revised plan as approved by the Planning Commission. The revised plan showed a 30' setback. The first plan approved showed the correct setback. Applicant claims the hardship of having relied on the revised site plan to have the sign located at 30' from the road. The cost of correcting the error pursuant to the required setback of 50' is attached. Applicant claims further the hardship of sight distance for identification in the south and northbound lanes. Zoning Ordinance Requirement Article 8, Section 8-4 states that all structures except sign advertising sale or rent of the property shall be located fifty (50) feet or more from any street right-of-way. Staff Comment The Site Plan Technical Review Committee noted the setback on the first submitted site plan. Their review generally includes careful attention to signs, as well as more important matters. Setbacks are handled, however, by the sign permit process. The sign was set before the inspector arrived. The revised site plan noted the incorrect setback by changing the number from 50 to 30. The applicant states he relied on the revised approved plan in setting his sign. The applicant has acted in good faith and feels he has incurred an inadvertent error. The Board approved a recent setback variance of 23' for the adjoining property owner, Badger Powhatan. Staff feels only a variance merited on similar grounds as shown by the former variance should be granted, if at all.
