Proposed Variance
Applicant requests relief from Section 2-3 of the Albemarle County
Zoning Ordinance to allow a single family residence to be 40 feet from
the road right-of-way. The applicant claims the hardship of topographic
conditions and other code and ordinance requirements that make emplace-
ment of the dwelling at the required setback impractical.
Zoning Ordinance Requirement
All structures, as herein specifically defined, shall be located a minimum
of seventy-five (75) feet from any street, road, or access easement.
Staff Comment
The applicant must set her septic system 200 feet from the rear stream
since she is located in the watershed designated by the County's Run Off
Control Ordinance. The proposed placement of the house is no closer to
the road than the residence adjoining the applicant. The back part of
the applicant's lot slopes deeply.
Staff recommends approval with no conditions.
