Goolsby Tax Map 79B Parcel 5B-i Acreage: Zoned: A-1 Existing Activity Vacant Lot (Subdivision existing prior to Zoning) Proposed Variance Applicant seeks relief from section 2-3 of the County Zoning Ordinance to allow a single family residence to be positioned 25 feet from the road right-of-way. Zoning Ordinance Requirement Article 2, Section 2-3 states all structures shall be located a minimum of seventy-five (75) feet from any street, road or access easement. Staff Comment Applicants claim the hardship of topographic conditions and a rear stream with the lay of the land that dictates a variance to achieve the best house location. (See VA-78-11 and plat.) Some houses in the area are as close as that proposed by the applicant. GRAY, M.D. ROUTE 1, BOX 11-H KESWICK, VIRGINIA 22947 March 11 , 1978 Board of Zoning Appeals , Albemarle le County, 414 East-Market Street, Charlottesville Virginia, 22901 , Dear Gentlemen: We have received your letter notifying us of a public hear- ing March 14, 1978 before your board,to take up the question of the application of Emmett Goolsby requesting relief from section 2-3 of the Albegarle County Zoning Ordinance to permit him to position single family residences 25 feet from the road right-of-way . These properties are described as Tax Map 78B, Parcels 01-63 and Parcel 01-5B. We believe Mr .Goolsby plans to build two houses on these parcels ( personal communication from him) and we suppose is applying to position each of them 25 feet from the road . We speak,of course, as adjoining property owners,as well as home owners in this small subdivision. The homes built here up to the present time are on }.ots of 11 to 2 acres and have been built by those intending to occupy them as their home. We believe all of them have a setback from the road right-of Way of at least 75 ft . -- both those built before the present requirement of 75 ft . (before April 12,1966) and those built since. This creates a pleasant and uniform appearance as well as increasing their value. Any depart- ure from this total plan would create a haphazard and Less pleasant appearance, as well as to possibly downgrade present property values . Mr .Goolsby,we presume, does not intend to occupy the houses on his property himself but is developing the property to sell (personal communication from him) and therefore is giving priority to lower costs rather than final appearance of the houses or their eventual value Furthermore we are sure that Mr .Goolsby was aware when he purchased the property of any possible difficulties of building within the code. He purchased the properties within the past few weeks and is the third owner in the Last nine months . The land was cleared by the second owner in July,1977 so Mr .Goolsby purch- ased it knowing the exact Layout of the land. It seems also that he would have investigated,before purchase, the zoning Laws concerning the required setback. We feel sure he must have obtained estimates of the cost of complying with the zoning laws. So he must have been fully aware of the entire situation and entered into his contract with his eyes open. We do not believe the code should be altered to fit the property(or the convenience of the builder ) but rather that the property should be altered where necessary to fit the code ( even though at some inconvenience to the builder ) .
