Zoned A-1, Building Permit 77-25
Dear Mr. Pritchett:
A zoning inspection of lot 10, Building Permit 77-25, a single family
dwelling located in Mountain View Subdivision, was found to be in violation
of Section 2-3 of the Albemarle County Zoning Ordinance.
Section 2-3 requires that all structures be located 75 feet from the
right-of-way. Your house, at the nearest point, was found to be 65 feet
from the right-of-way.
The Zoning Administrator understands your have been informed of this
violation several times by inspectors of this office and that you were
requested on February 14, 1978, to process a variance application to avoid
prosecution and to process the application before the deadline of February
27, 1978, for the March meeting of the Board of Zoning Appeals. This dead-
line has expired and the Zoning Administrator received no application.
The Zoning Administrator requests that you process a variance application
for the 1978 April agenda of the Board of Zoning Appeals immediately. The
deadline for filing is March 27, 1978, and at the April 11, 1978, meeting of
the Board of Zoning Appeals, you must demonstrate a hardship to the Board in
order for this home to be in lawful compliance of the Zoning Ordinance. Your
failure to proceed diligently shall result in prosecution under the Zoning
Ordinance legal remedies. I hope we can have your cooperation on this matter.

Single Family Residence already occupied with a temporary Certificate
of Occupancy.
Proposed Variance
Staff has incorporated the comment of Mr. Pritchett's lawyer, Mr. James
Deinlein.
The applicant requests a variance from the 75 foot setback requirement
because of undue hardships. The property was purchased in January, 1977.
The house was constructed in the Spring of 1977 andwas set back from State
Route 751 in line with and in conformity with the houses already constructed
in Mountain View Subdivision.
The subdivision plat of record in Albemarle County Clerk's office deed
book 510, pages 616-617 shows a 25 foot dedication for road purposes, but
does not show the actual width of the road. The dedication actually extends
15 feet beyond the edge of the hard surface road.
The applicant constructed the house unaware that a right-of-way extended
15 feet beyond the edge of the existing road. The shortest distance from the
edge of the road to the house is 80 feet; but the shortest distance from the
right-of-way boundary to the house is 65 feet.
Accordingly, a variance is requested for the 10 foot setback violation.
Significantly, the adjoining house owned by Luther F. Gibson and Nancy W. Gibson
is only setback 53 feet from the right-of-way.
Zoning Ordinance Requirements
Section 2-3 of the Albemarle County Zoning Ordinance states that all structures,
as herein specifically defined, shall be located a minimum of seventy-five (75)
feet from any street, road, or access easement.
Staff Comment
The setback of 75 feet was required October 20, 1976. The applicant or
his contractor apparently failed to fully inform themselves as to both deed
easements and County requirements. Minimizing this error is the fact other
homes are as close or closer.
If the Board chooses to grant the variance, the staff recommends no
conditions of approval.
