Javor Tax Map: 59 Parcel: 23B Zone: B-1 Acreage : 1 . 928 Existing Activity Vacant Lot Proposed Variance Applicant seeks a variance from Article 18, Section 18-3-1 of the County Zoning Ordinance so that any structure permitted in a B-1 Zone be allowed to be constructed with a 74 foot setback rather than the 150 feet as stated in Section 18-3-1 . Appli- cant states the variance is warranted since the B-1 zoning privilege of this property, which is 200 feet deep, would be largely confiscated if he abided by the 150 foot setback. Therefore, he requests that any structure associated with the B-1 Zone be allowed to be constructed with a uniform 74 foot setback. Zoning Ordinance Requirement No structure, except as hereinafter provided in the case of certain signs , shall be constructed within one hundred fifty (150) feet of the right-of-way of any designated scenic highway or Virginia byway having a right-of-way width of fifty (50) feet or more, nor within one hundred seventy five (175) feet of the right-of-way of any such highway or byway having a right - of-way width of less than fifty (50) feet. Staff Coiuiiient A similar request was made by Mr. Kirtley, adjoining property owner of M-1 zone land, and the Board of Zoning Appeals approved the variance. However, the uniform setback line variance was approved with the assurance by the applicant that a profes- sional office building would be constructed as such was more in keeping with the Scenic Highway. In turn, Kirtley sought the assurance from the Board that at a later date, if he so desired, he could build any structure associated with the M-1 zone at that setback and the Board made the motion and approved the re- quest . (Attached are the uses allowed in the M-1 zone and the B-1 zone.) If a special use permit were required and it was denied, of course Mr. Kirtley could not build the structure associated with the special use. The applicant proposes the location of a gas station. This matter was first deferred. The Board had requested a set of plans to review before ruling on a variance. A withdrawal without prejudice was later made by the applicant . Therefore this is a new application for a uniform variance similar to that which was granted by the Board to Mr. Kirtley. The Zoning Ordinance will require 60,000 square feet for any septic system where a lot is served neither by a central sewer or water system and 40 ,000 square feet where a lot is served by one or the other. Unusual soil conditions may require additional square footage. The applicant would also be sub- ject to the Run Off Control Ordinance and Site Plan Review before the Planning Couuuission. Market Street Charlottesville, Virginia 22901 Re: Petition by Henry Gavor Gentlemen: It is my understanding that a Mr. Henry Gavor is petitioning the Board to give him relief from the 150 foot setback provision concerning Route 250 as a Scenic Highway. My view of this matter is that since Route 250 West has been designated as a Scenic Highway, relief from the 150 foot provision should not be granted. The purpose in establishing such a requirement is to keep our highways truly scenic. By granting property owners' requests for relief of that particular requirement certainly is not in keeping with the intent of the original decision regarding scenic highways in the state of Virginia. We understand that Mr. Javor intends to locate an automobile gasoline and service station on this property and we feel that such a use of the property, particularly in close proximity to the frontage of Route 250 , would be in derogation of the spirit and intent of the scenic highway ordinance. We understand that this matter is to be heard by the Board of Zoning Appeals on Tuesday, April 11 at 2 : 00 P. M. and we will do our best to have a representative of our Association there to voice our concern about this application. Staff Comment The applicant was granted an earlier variance (VA-77-31) to place a vet- erinary hospital to be 74 feet from the right-of-way. (This use is allowed by a special use permit.) The veterinary hospital contract for purchase of the applicant and his buyer never matured and the applicant now has another potential buyer who does not wish to construct a veterinary hospital. A special use permit for the veterinary hospital was sought by the applicant (SP-77-30) and the Planning Commission approved the permit with conditions. (attached) The applicant requested deferral of his special use permit in- definitely. The adjoining property,owned by W. J. Kirtley, was granted a uniform 74 foot setback. If the Board chooses to approve the variance, the staff recommends the fol- lowing conditions: Staff Report (Continued) VA-78-06. Henry J. Javor 1) A landscape plan will be submitted with the site plan for Planning Commission approval. 2) Preservation of as many trees as feasible shall be determined and included on the site plan. 3) The applicant withdraw VA-77-31. The Board may wish to consider the Planning Commission comments in their deliberations.
