Irene Dunnivan Tax Map: 35 Parcel: 30A Acreage: 3/4 acre Zone: A-1 Existing Activity Single family residence Proposed Variance Applicant requests relief from section 2-3 of the Albemarle County Zoning Ordinance to place a storage shed on the property 45 feet from the right-of-way, a variance of 30 feet. Zoning Ordinance Requirement Section 2-3 of the Albemarle County Zoning Ordinance states all structures, as herein specifically defined, shall be located a minimum of seventy-five (75) feet from any street, road or access easement. For purposes of this section only, the term "structures" shall not be deemed to include on-site signs for sale or rental of property, shelters designed and used by school children traveling to and from school, or structures, other than signs, for which no permit is required under the Unifrom Statewide Building Code. Staff Recommendation Accessory buildings can be as close as 5 feet from the property line. The lot is irregular and the applicant seeks to place the shed to the narrowest side of the lot. Staff feels the Board of Zoning Appeals should explore the feasibility of the applicant moving the shed to a wider and deeper part of this lot and the idea of reducing the size of the shed. Unless the applicant can show a demonstrable hardship, the staff recommends denial unless the exploration of above shows no other available site on the property that would require as sizable a variance.
