Applicant requests relief from section 2-3 of the Albemarle County
Zoning Ordinance to allow a new structure to be positioned 50 feet
from the right-of-way, a variance of 25 feet. This variance is
requested to retain view factor looking S.E. from site of old house
and approximate location of new dwelling.
Zoning Ordinance Requirement
Section 2-3 of the Albemarle County Zoning Ordinance states all structures
as herein specifically defined, shall be located a minimum of seventy-five
(75) feet from any street, road or access easement. For purposes of this
section only, the term "structures" shall not be deemed to include on-site
signs for sale or rental of property, shelters designed and used by school
children traveling to and from school, or structures, other than signs,
for which no permit is required under the Uniform Statewide Building Code.
Staff Recommendation
The applicant desires to seek the best view on the site for his home.
The staff notes the Bishop Hill Subdivision set a seventy-five foot
setback on the longest side aside from the 25 foot dedication in com-
pliance with the zoning ordinance. (plat attached) (The 30 foot building
line is likely in error.)
Unless the applicant can show a demonstrable hardship or other extra-
ordinary circumstances, staff recommends denial.
If the Board chooses to approve the variance, the staff recommends no
conditions.

THIS CONTRACT OF PURCHASE made as of April 14, 1978 , between:
W. NORRIS FOSTER and JOSEPH H . COBB (herein called "Purchaser") and
the heirs of Lee Bishop (herein called "Seller") , provides that

6 . If either Purchaser or Seller defaults under this Contract

provided in the description of the property above.
