Single-Family Residence "The Walker House"
Proposed Variance
Applicant seeks relief from section 2-3 of the Albemarle County Zoning
Ordinance to allow an addition to a single family residence to be po-
sitioned 25 feet from the right-of-way; a variance of 50 feet.
Zoning Ordinance Requirements
Section 2-3 of the zoning ordinance states: All structures, as herein
specifically defined, shall be located a minimum of seventy-five (75)
feet from any street, road, or access easement. For purposes of this
section only, the term "structures" shall not be deemed to include on-
site signs for sale or rental or property, shelters designed and used
by school children traveling to and from school, or structures, other
than signs, for which no permit is required under the Uniform Building
Code.
Staff Recommendation
Unless the applicant can show a demonstrable hardship or other extra-
ordinary circumstances, staff recommends denial.
If the Board chooses to approve the variances, the staff recommends
no conditions.
Note:
The right-of-way has not been determinable. It is the burden of the
applicant to show by deed reference the dedicated right-of-way if such
is not known to the Zoning Administrator or his staff. In this instance,
the right-of-way at the time of application was unknown. The applicant
was informed he should seek to ascertain the right-of-way.
