HomeMy WebLinkAboutSDP201800083 Review Comments Appeal to BOS 2019-04-29County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 434-296-5832 Memorandum To: Scott Collins From: Christopher Perez, Senior Planner Division: Planning Date: April 29, 2019 Subject: SDP2018-83 Briarwood Phase 8 - Minor Amendment The County of Albemarle Planning Division will grant or recommend approval of the Site Plan Amendment referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [32.7.9.51 Landscaping. Provide the 4 required street trees fronting Lots 120 - 127. Medium shade trees are appropriate in this location. There appears to be enough space to locate the trees 10' from the drainage pipe. [21.7(c)] Currently the plans propose offsite sidewalks, curbs, and grading located on the adjacent C-1 zoned property, specifically to the south and east property lines of the site and at the entrance along Camelot Drive. Prior to the minor site plan being approved a boundary line adjustment plat and or easement plat shall be reviewed and approved to permit the improvement to remain in their current location. Additionally, prior to plat approval a special exception to the 20' undisturbed buffer requirement of Section 21.7(c) shall be submitted and approved prior to plat and/or site plan approval. Rev 1: The applicant has applied for special exceptions related to omitting the sidewalk and landscape strip on the southern portion of Elm Tree Court, this request if approved would sufficiently omit the need for the offsite improvements that were previously depicted, thereby omitting all issues mentioned above. The special exceptions shall be approved by the Planning Commission prior to site plan approval. Rev 3. Comment appears addressed through a "thing decided" determination from the Zoning Administrator, pending a written determination from Amelia. Site plan shall not be approved till I receive something in writing from Amelia on this decision. 3. [32.7.2.3, 14-422(B), Design Standards Manual (F)] Sidewalks. The sidewalks in the development shall be 5' wide, currently they are 4' wide. Revise. Rev 1: The applicant has applied for a special exception to facilitate this reduction. The special exceptions shall be approved by the Planning Commission prior to site plan approval. Rev 3. Comment appears addressed through a "thing decided" determination from the Zoning Administrator, pending a written determination from Amelia. Site plan shall not be approved till I receive something in writing from Amelia on this decision. 4. [32.7.9,14-317] Depict, dimension, and label all 6' landscape easements for the street trees to be permitted on residential lots. Depict, dimension, and label the sidewalk and access easements on the residential lots. Prior to final plat approval a maintenance agreement for these plantings and the sidewalks shall be reviewed and approved by the County Attorney. Additionally, a maintenance agreement for the private street shall also be submitted for review and approval by the County Attorney. Rev 1: Comment partially addressed, pending submittal of legal docs for County Attorney review/approval. Rev 3. Legal docs submitted, County Attorney has required changes. Pending resubmittal by applicant. 5. [18-21.7(c)] Disturbance of the 20' undisturbed buffer. A special exception is required to permit the disturbance of the 20' undisturbed buffer as depicted on the plans, which proposes permanent location of a storm drainage pipe and associated easement and grading located in this buffer. Prior to final plat and site plan approval the special exception shall be submitted and approved by the BOS. Rev 3. Comment appears addressed through a "thing decided" determination from the Zoning Administrator, pending a written determination from Amelia. Site plan shall not be approved till I receive something in writing from Amelia on this decision. 6. ZMA2004-14, ZMA2005-9, 14-234(C)(4)] Application Plan. Elm Tree Court (Private Road) connection to Camelot Drive (Public Road) is not permitted by the rezoning's application plan and shall be omitted prior to approval of the site plan and final plat. Rev 3. Comment appears addressed through a "thing decided" determination from the Zoning Administrator, pending a written determination from Amelia. Site plan shall not be approved till I receive something in writing from Amelia on this decision. 7. ZMA2004-14, ZMA2005-91 Proffer 11— Affordable Housing. Eight (8) affordable units are required inphase 8. Depict and label these units on the final plat and site plan. The previously approved plans depicted these units as being Lots 112-119. Provide a chart on the cover sheet of these documents tracking all required 25 affordable units. Rev 3. Comment Addressed. VDOT — Adam Moore Approved ACSA — Richard Nelson 1. No objection Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
