Proposed Variance
Because of the unusual alignment of the highway right-of-way, this property
has an irregular right-of-way at the front of the lot. Applicant requests
that the setback be reduced from 30 feet to 0 feet and contract purchaser
be allowed to build to the front property line. This will allow the
building to be aligned with the setback line of adjoining properties.
(Note: No variance is sought for sign location.)
Zoning Ordinance Requirement
All structures, except signs advertising sale or rent of the property,
shall be located thirty (30) feet or more from any street right-of-way.
Staff Recommendation
The applicant claims the hardship of a steep bank to the rear and the required
setback of 30 feet which places the proposed structure further back than other
existing structures in that Route 29 area. This, he feels, is due to the odd
right-of-way which the applicant tried to purchase and which right-of-way he
has stated may be in excess of what the Highway Department needs.
The applicant feels positioning of the building in accordance with all pro-
visions of the B-1 zone places the building, if it is set as shown, almost
into the steep bank. The land is relatively flat having been graded some
time ago.
Unless the applicant can show a demonstrable hardship, staff would have to
recommend denial. The building could be positioned North to South rather
than East to West and meet the required setback.
If the Board chooses to approve the variance, the staff recommends the
following conditions:
1) The variance be limited to the building being in line with other
existing structures on Route 29.
2) No sign variances are to be allowed.
