Tucker, Jr. - Director of Planning Re: SCENIC HIGHWAY SIGN - Kirtley Realty I have reviewed the attached sign proposal for location on Route 250 West and find it to be basically in keeping with the Scenic Highway Ordinance. This approval does not speak to the sign's size or dimensions, however. Kirtley, Jr. Tax Map: 59 Parcel: 23B-1 Zoning: M-1 Existing Activity Professional office building Proposed Variance The applicant requests relief from section 18-3-1 to allow a free-standing business sign to be located 20 feet from the right-of-way; a variance of 130 feet . Zoning Ordinance Requirements No structure , except as hereinafter provided in the case of certain signs , shall be constructed within one hundred fifty (150) feet of the right-of-way of any designated scenic highway or Virginia byway having a right-of-way width of fifty (50) feet or more, nor within one hundred seventy-five (175) feet of the right-of-way of any such highway or byway having a right- of-way width of less than fifty (50) feet. Staff Recommendation The applicant presently has a variance to locate an office building 74 feet from the right-of-way. (VA-77-67) The proposed sign location is to be on the grassy area of the site plan. Material proposed is a french rod iron de- sign with wood to indicate tenants . A "for lease" sign is also to be utilized on this sign until the building is leased. The applicant claims the hilly area of Route 250 west requires the sign to be closer to the road and also that placing the sign beyond 30 feet from the right-of-way will cause the sign to be in the parking lot . If the Board chooses to approve the variance , staff recommends no conditions . (It should be noted that in the M-1 zone the setback is 50 feet . ) ✓fl-'i / Chessie System P. 0. J. Kirtley, Jr. for locating a free standing sign. There was no Chessie System representative present at the public hearing due to my not receiving your letter until October 11. We have no objection to the zoning change provided the sign is located a sufficient distance from our operating right-of-way as not to obstruct sight distances necessary for safe train operation or be lighted in such a fashion as to allow our personnel to interpret it as a signal indication. The variance re- quest refers to a sign setback' requirement of 150 feet while the ordinance states. . . "no sign shall be located within fifty (So) of the right-of-way of any designiated scenic highway or Virginia byway. . . " . with some exceptions (noted in paragraph in ordinance) that may be erected :itin the fif-y feet. But in any case, with reference to the requested variance, we would like to indicate our concerns as noted on the enclosed rage. Incidentally, a number of people have exrressed surprise at the narrowness of the setback and the problems likely to arise with entrance and exit from 25C west to this site. As a result of a variance granted for a building setback on this parcel, a building is being constructed that is closer to Route 250 west than 'existing commercial structures on either side. Is, a result we are concerned about problems of access to this site on an increasingly traveled road at a particularly hilly stretch. There is only a short distance between the highway right of way and the entrance to this parcel as planned, making entrance and exit from Rt 250 west difficult. We urge careful review of the safety problems. We are also concerned about the impact on this road of the design and location of any sign for its impact on the area as well as the question of safety.
