Mulberry Corporation Tax Map: 61X(1) Parcel: 2 & 2A Zoned: PUD Existing Activity Four Seasons Mall Proposed Variance Applicant seeks relief from section 2-7-9 of the Albemarle County Zoning Ordinance to allow a free-standing sign to be located 15 feet from the right-of-way; a variance of 35 feet. (Outside perimeter M-1 Zone, 50' setback.) Zoning Ordinance Requirements There shall be no minimum setback or yard requirement in a planned community; except that all structures to be located on the outer perimeter of the planned community shall conform to the setback and yard regulations of the adjoining district; provided that setbacks from roads, streets, or access easements shall be determined by the planning commission. Staff Recommendation Unless the applicant can show a demonstrable hardship, the staff must recommend denial. If the Board chooses to approve the variance, the staff would recommend moderate landscaping around the sign such as small english boxwood or other appropriate landscaping the applicant may wish to plant. Mulberry Corporation authorizes you to immediately contract to spend up to $15,000 for neces- sary repairs to the Center. Such repairs shall include: 1) Landscaping 2) Replacement of the missing railing on the second floor level . 3) Extension of the railing on the third floor level to deter anyone from having easy access to the roof of the Steak House. 4) Replacement of the warped beam on the walk-way to the Steak House. 5) Any necessary repair to the Parking Lot. In addition, I would like your assistance in renegotiating leases with existing tenants as well as obtaining new leases. I would like to retain your services as a consultant during this interim period of ne- gotiating leases and making necessary repairs. I understand you will I believe this covers our previous discussions.
