Proposed Variance
Applicant seeks relief from section 2-7-9 of the Albemarle County Zoning
Ordinance to allow a free-standing sign to be located 15 feet from the
right-of-way; a variance of 35 feet. (Outside perimeter M-1 Zone, 50'
setback.)
Zoning Ordinance Requirements
There shall be no minimum setback or yard requirement in a planned community;
except that all structures to be located on the outer perimeter of the planned
community shall conform to the setback and yard regulations of the adjoining
district; provided that setbacks from roads, streets, or access easements shall
be determined by the planning commission.
Staff Recommendation
Unless the applicant can show a demonstrable hardship, the staff must recommend
denial.
If the Board chooses to approve the variance, the staff would recommend
moderate landscaping around the sign such as small english boxwood or
other appropriate landscaping the applicant may wish to plant.

Dear Doug:
Confirming our discussion of August 3, this letter will serve to
outline the arrangement between you and your firm and Mulberry Cor-
poration regarding the Four Seasons Shopping Mall . Mulberry Corporation
authorizes you to immediately contract to spend up to $15,000 for neces-
sary repairs to the Center. Such repairs shall include:
1) Landscaping
2) Replacement of the missing railing on the second floor level .
3) Extension of the railing on the third floor level to deter
anyone from having easy access to the roof of the Steak House.
4) Replacement of the warped beam on the walk-way to the Steak
House.
5) Any necessary repair to the Parking Lot.
In addition, I would like your assistance in renegotiating leases
with existing tenants as well as obtaining new leases. I would like to
retain your services as a consultant during this interim period of ne-
gotiating leases and making necessary repairs. I understand you will
I believe this covers our previous discussions. If you are agree-
able to the terms set forth in this letter, please execute the enclosed
copy and return to me in the envelope provided. I appreciate the time
you have spent on this project thus far and look forward to working with
you in the future.

THIS DEED, made this 8th day of June, 1978, by
and between BRUCE A. KAY, Substitute Trustee, first party,
and MULBERRY CORPORATION, a Virginia corporation, second party.
W I T N E S S E T H:
WHEREAS, Woodlake Corporation by deed dated June 10,
1974 , and recorded June 17, 1974 , in the Clerk ' s Office ,
Cirucit Court, Albemarle County, Virginia, in Deed Book 554,
at page 69, did convey unto John W. White and William T. Luck,
Jr. , Trustees, the hereinafter described real estate in trust
to secure the principal amount of $1, 080 ,000 . 00 and interest,
evidenced by a certain promissory note dated June 10 , 1974 ,
in the original principal amount of $1, 080,000. 00 , payable
to the order of The Central National Bank of Richmond; and
WHEREAS, by order of the Circuit Court of Albemarle I
County, Virginia, admitted to record in the Clerk ' s Office,
Circuit Court, Albemarle County, Virginia, in Deed Book 645,
at page 684, Bruce A. Kay was appointed as Substitute Trustee;
}
and
WHEREAS, default was made in payment of the debt
secured by said deed of trust and in the performance of the
covenants in said deed of trust; and
WHEREAS, The Central National Bank of Richmond as
the Noteholder of the aforesaid note exercised the option
given it in the deed of trust and declared the debt thereby
• secured as immediately due and payable and directed said
first party to sell the real estate conveyed by same; and
WHEREAS, being required to do so by the holder of
said note, Bruce A. Kay, Substitute Trustee, in the execution
• of said trust, did, on the 8th day of June, 1978 , after
giving fourteen days notice by certified mail to the owner

of the real estate and after advertising the time, date,
place and terms of sale in The Daily Progress, a newspaper
having a general circulation in the County of Albemarle,
Virginia, offer for sale the real estate described below
with improvements thereon at public auction to the highest
bidder, for cash, according to the terms of the deed of trust,
at which sale Mulberry Corporation, a Virginia corporation,
became the purchaser thereof, having made the highest bid
in the amount of $592,000. 00.
NOW, THEREFORE, THIS DEED WITNESSETH: That in

consideration of the sum of $592,000.00 as aforesaid, the
receipt of which is hereby acknowledged, and in discharge

of his duty as Substitute Trustee, the said first party
hereby grants and conveys with SPECIAL WARRANTY of TITLE
unto the second party the following described real estate,
to-wit:
ALL that certain tract or parcel of land
in Albemarle County, Virginia, together
with all improvements thereon and appurte-
nances thereto, designated as Parcel A--2
and containing 5. 51 acres, more or less,
shown on a plat by William S. Roudabush,
Jr. , C.L.S. , dated October 1973 , recorded
in Deed Book 543, page 499, less and except
22,500 square feet designated on said plat
as a "service station site" (now to be
corrected to a "Bank Site") .
This conveyance is made subject to any easements,
conditions and restrictions of record with respect to
said property to the extent that the same are now applicable
thereto.
