Applicant seeks temporary relief from section 2-2 and 10-6 of the Albemarle
County Zoning Ordinance to allow a second mobile home to be located on less
than two acres and to allow the expansion of a non-conforming use for a desig-
nated time.
Zoning Ordinance Requirements

2-2: The minimum lot area for each single family dwelling shall be two (2) `r
acres.
10-6: Any lot on record at the time of the adoption of this ordinance which
is less in area and/or width than the minimum required by this ordinance may
be used in a manner consistent with the uses permitted for a lot having the J
minimum area and/or width so required; provided, that the rear, side and front
yard and setback requirements of this ordinance shall be maintained; and pro-
vided further that no such use shall be permitted which is determined by the
zoning administrator to constitute a danger to public health, safety and general
welfare.
Staff Recommendation
The applicant is very poor and has lived in the Afton Mountain area nearly all
of her natural life. Her need for a temporary variance is due to her daughter's
terminal illness which requires the mother to be close by. The setting of the
mobile home afforded the mother the nearest and the best possible location to
watch over her daughter and her daughter's possessions when she is away. Other ti
mobile homes are located in the area.
The staff sees no legal hardship for a permanent variance. However, a compassionate
ha.l.ship exists above the legal requirement and the staff recommends a temporary
variance until such time the daughter no longer lives in the mobile home.
From that date, staff recommends the following condition:
:\ The mobile home in violation be moved to a proper legal parcel within 6
months after vacation of the same.

We are in receipt of a letter of Glenna Ratcliffe, dated dated 5 December
1978, regarding application of Mary Arlene Blackwell (Tax Map 69A,
Parcel 94) for a second mobile home and request for expansion of a
non-conforming use.
As adjoining property owners, the Brooksville Corporation wishes to
express opposition to the existing mobile home and would most certainly
be concerned about additional mobile homes on this or other nearby
properties.
