Applicant seeks relief from section 7-4 of the Albemarle County Zoning Ordinance
to allow a building to be located 28 feet from the rear property line; a variance
of 22 feet.
Zoning Ordinance Requirements
For permitted uses, the minimum side and rear yards adjoining or adjacent to a
residential or agricultural district shall be fifty (50) feet.
Staff Recommendation
Unless the applicant can show a hardship the staff recommends denial. The applicant
claims the location of the building is essential to obtain the necessary parking.
If the Board chooses to approve the variance, the staff recommends:
1) Preservation of all vegetation and trees 15 feet from the property lines or
a landscape plan providing for a. tree buffer.

Note: The Board may wish to consider the reduction in the size of the building
with the applicant.

Gentlemen:
Enclosed is a copy of a site plan which has been sub-
mitted to the Site Plan Review Committee for approval.
We were informed that we did not comply with the 50
foot setback required on B-1 properties adjacent to proper-
ties zoned A-1. In this instance, the A-1 designated pro-
perty is the C & 0 Railway right-of-way. We hereby request
a variance of the 50 foot setback requirement for the fol-
lowing reasons:
1. The site is rather small and, in order to meet the park-
ing requirements, it was necessary to place the build-
ing within the 50 foot limit to the south edge of the
property.
2. The extreme change in grade (20 '±) from the property
line to the actual railway tracks provides a buffer
equivalent to the intention of the current 50 foot set-
back requirement.
3. There seems to be precedent for waiving the regulation;
the adjacent property to the east, bounded by the same
right-of-way and zoned B-1, contains an office building
which is situated approximately 40 feet from the actual
tracks, and nearly on the same elevation. This build-
ing and the railway coexist with no apparent ill effects.
