Applicant seeks;relief from section 2-2 of the Albemarle County Zoning Ordinance
to allow a single family dwelling to be located on 1.85 acres; a variance of
. 15 acres.
Zoning Ordinance Requirements
The minimum lot area for a single family dwelling shall be two (2) acres, except
in the case of unusual soil conditions or other physical factors which may impair
the health and safety of the neighborhood, in which case upon recommendation of
the City-County Health Officer, the Planning Commission may increase the lot area
requirements.
Staff Recommendation
The applicant is seeking to preserve the home of their parents which they have
lived in for the last 20 plus years. The parents have always rented the property
and the applicant seeks to purchase it for them.
The existing acreage would not allow for the division of 2 separate parcels since
the division would require 2 acres each.
The staff recommends denial of the variance unless the applicant:
1) Can show a legal hardship.
2) Has exhausted other alternations such as seeking to purchase additional land.

The 1.85 acre portion (including dwelling) of the 3.85 acre tract owned by
Louisa C. Morris located on the west side of state route 660 in Albemarle
County, Virginia has been offered for sale to Charles and Norma Wood For the
sum of 025)000 subject to approval of such sale by the Albemarle County
Planning Commission.
