Proposed Variance Applicant seeks relief from section 7-3 to allow Wendy's Restaurant's "in" and "out" signs to be located 10 feet from the right-of-way; a variance of 20 feet. Zoning Ordinance Requirements All structures, except signs advertising sale or rent of the property shall be located thirty (30) feet or more from any street right-of-way. Staff Recommendation The Board has granted this sort of setback variance before in the interest of highway safety. The signs being less than 5 square feet in area tech- nically do not require a sign permit. If the Board chooses to approve the setback variance staff recommends the following conditions: 1) In the event of Highway improvements, Wendy waives any claim to damages for having to move the signs and the signs shall, at that time, be set back the allowed variance. 11441 Sit , riv 2) The signs may be no taller than Z feet from the ground. j 3) No advertising loco may appear on the signs. 4) Highway Department approval for site distance. Smaha / /7E6 Plainview Plaza Suite 590 Louisville, Kentucky 40223 7 Dear Joe: Just a note to confirm the conversations that you and I have had by telephone and in person with Mr. Benjamin Dick of the Albemarle County Planning Department. (1) Your 'enter" and "exit'' signs will be less than five square feet, thereby not falling under the sign ordi- nance as far as getting a permit. (2) We are applying for a variance to place these signs approximately ten feet outside the right-away so they will be visible to oncoming traffic, thereby being a safety factor and guiding people in and out of the restaurant lot. Also, since these signs will each be less than five square feet they do not count as a sign as far as having only two freestanding signs per parcel . (3) We are also applying for a variance to exceed the 100 square feet because of the following reasons: (A) Air space in the front sign has to be there due to the fact that a one foot space is needed for tools to work, if the sign has to be repaired, both in the bottom of the big sign and the top of the small sign. (B) Our menu sign is in the back of the building and does not show from the highway, and is not obnoxious as far as U.S. 29 traffic is concerned. (4) We did not discuss this over the telephone this morning but both Mr. Dick and I saw in the brochure that you sent us that your single face front sign in Charlottesville is only to he 5 x 30 . Please make a notation, of this when you are ordering your signs . Otherwise, if it is larger than 5 x 30 you will be in violation of the code again. V oe 40 Page Two Mr. Joseph P. Smaha December 28, 1978 Joe, Mr. Dick suggested that you personally he here to make the appeal for the signs if at all possible. The meeting will he on Tuesday, February 13, at 10 :00 a.m. Also, Mr. Dick suggested that you might bring proof of vested interest in these signs such as copies of orders already gone out to the factory for production to start on the signs , etc. as a vested interest sometimes adds a little weight when you are asking for a variance. I hope your jaw will be getting better and that the infection is down. I hope your New Year will be happier than your Christmas . Vice President 191$ Soil Erosion & Sedimentation Control Report for Wendy' s Old ras'iioned Hamburgers Dec. 5, 1978 This plan proposes to grade for commercial development approximateiy 1.32 acres of property on U.S. Rt. 29. The major part of this work will involve cut operations, the waste area for the extra material (as yet unselected) will need a further soil erosion permit. Before any major grading is begun, the sediment barriers will be installed as shown on the accompanying drawing. These , barriers will be built out of hay bales, rock piles, or any other method agreed upon between the Albemarle County Engineer and the project engineer. Once the temporary measures are installed and operable, the clearing and ear th'hovin g work may begin. These measures will be checked periodically and cleaned .as necessary to insure their continuous and efficient icient opera- tion. Once final grades are achieved, the disturbed areas will be stabilized as=shown on the plan. The temporary measures will be removed as soon as they are no longer needed and the , I areas of their former existance cleaned up in a workmanlike manner. During the period of construction, a 30 ft. x 50 ft. gravel pad will be maintained at the entrance to the site to clean mud off of the tires of cars and trucks leaving the site. IOW $20.
