Box 7766 Charlottesville, VA Re: Board of Zoning Appeals Action VA-78-82 Dear Mr. Birckhead: This letter is to inform you that on February 13, 1979, during the regular meeting of the Albemarle County Board of Zoning Appeals, your application for VA-78-82 was approved with the following conditions: 1. In the event of Highway improvements, Wendy's waives any claims to damages for having to move the signs and the signs shall, at that time, be set back the allowed variance. 2. The signs may be no taller than 3 feet from the ground and less if to afford adequate site distance. (See #4) 3. No advertising logo may appear on the sign. 4. Highway Department approval for the site distance. This variance allows relief from section 7-3 of the Albemarle County Zoning Ordinance to allow Wendy's Restaurant "in" and "out" signs to be located 10 feet from the right-of-way; a variance of 20 feet.
