Tax Map: 61 Parcel: 120N(pt.of) Zoned: B-1 Existing Activity Restaurant Proposed Variance Applicant seeks relief from section 7-3 of the Albemarle County Zoning Ordinance to allow directional signs to be located 7 feet off the right- of-way of Route 29; a variance of 23 feet and 12 feet off the right-of-way of Route 631; a variance of 18 feet. Zoning Ordinance Requirements All structures, except signs advertising sale or rent of the property shall be located thirty (30) feet or more from any street right-of-way. Staff Recommendation The Board has approved these variances before for highway safety. This particular intersection is most active and can be dangerous. If the Board should approve the variance, the staff recommends the following conditions of approval: 1) Waiver by Hardee's of any claim to damages for having to remove the signs in the event of State Highway Department improvements. 2) The signs may be no higher than / feet from the ground level. 3) No advertising loco may appear on the signs. 4) Highway Department approval for site distance.
