Dear Mr. Dick:
With regard to the variance requested from
sign setback requirements for the Real Estate III
office building on Rt. 250 west, we would like to
indicate our position that this specific setback
request for this particular site should be decided
on the basis of a determination of the safety issue,
with its hardship implications.
We therefore suggest that a decision on this
variance be based on sight distances and the time
reruired for safe storping and exit from Rt. 250
west for vehicles traveling at normal -speeds on
this road.

Proposed Variance
Applicant seeks relief from section 18-3-1 of the Albemarle County Zoning
Ordinance to allow a 12 square foot business sign to be located 12 feet
from the right-of-way; a variance of 138 feet.
Zoning Ordinance Requirements
No structure, except as hereinafter provided in the case of certain signs,
shall be constructed within one hundred fifty (150) feet of the right-of-way
of any designated scenic highway or Virginia byway.
Staff Recommendation
Applicant's sign design will be in keeping with the intent of the scenic
highway. Applicant claims the need for the sign's location due to curb
coming east that restricts site distance and for the purpose of site
identification due to existing vegetation.
The staff would have to recommend denial unless proof of a hardship is
shown or other extraordinary circumstances. If the Board chooses to
approve the variance, staff recommends the following:
a) Planning Staff approval of landscape of sign.
b) The sign be maintained within 60 days after notice by the Zoning
Administrator in the event of storm damage or other cause of damage.
c) Tha variance runs with the owner and is not transferable.
d) Scenic Highway Sign submittal procedures are followed 2 weeks in
advance of the proposed setting of the sign.
