Proposed Variance Applicant seeks relief from section 2-3 of the Albemarle County Zoning Ordinance to allow 2 single family dwellings to be located 45 feet from the right-of-way; a variance of 30 feet. Zoning Ordinance Requirements All structures, as herein specifically defined, shall be located a minimum of seventy-five (75) feet from any street, road, or access easement. Staff Recommendation Applicant claims a topographical hardship and the close proximity of the Flood Plain. These physical features plus the need to locate septic systems in certain areas they urge merits a variance. The area in question is in our critical watershed. If the Board chooses to approve the variance, Staff recommends approval of a variance that allows the greatest setback possible and yet allows the applicant proper placement of septic systems. The applicant is also put on notice that the location of three or more rental units on a given parcel require a Planning Commission approved site plan. The staff recommends the following conditions: a) The houses be set far enough apart to allow for proper setbacks if the land were sub-divided to create individual lots. b) Verification from applicant to the County Engineer dwellings are not in the flood plain. c) Preliminary approval of site plan location by Planning Staff to assure compliance of paragraph (a) . d) Verification from Health Department that sufficient area around each dwelling for 2 septic systems for each dwelling in case one goes bad.
