Dear Mr. Dick:
I am responding to your notice of February 28, 1979, addressed to my deceased
wife, Alison Hamilton, concerning the petition of Mrs. Mariann Tejeda to allow
temporary directional signs to be located just off the highway right-of-way opposite
my home on Garth Road.
I have no objection to the locating of such signs on a temporary basis at
the time of her steeplechase operations. It is understood that they will be
removed after the event is over.
I do have great objection to the "DO NOT LITTER" sign that was installed
next to my rail fence on the north side_of Garth Road. I was not consulted on
this -- the sign just suddenly appeared there. It is very large and spoils the
entire approach to my place. I ask your help in getting it re-located on the
,�ksouth side of the road, perhaps just to the east of the steeplechase entrance

where it would do the most good as a reminder .to people coming to the steeplechase.

Proposed Variance
The applicant seeks relief from section 2-3 of the Albemarle County Zoning
Ordinance to allow temporary directional signs to be located up to the
right-of-way; a variance of 75 feet.
Zoning Ordinance Requirements
All structures, as herein specifically defined, shall be located a minimum of
seventy-five (75) feet from any street, road, or access easement.
Staff Recommendation
Staff recommends approval with the following conditions:
1) No sign shall obstruct proper site distance for highway safety.
2) The signs may not go up greater than 72 hours prior to the events.
3) Signs will be at least 8 feet off the edge of highway pavement.
4) All signs will be removed within 48 hours following the event.
5) All poles or sticks used for signs shall be removed within 48 hours

The variance sought by the applicant (Foxfield
Racing Association/Mariann Tejeda) includes signs
and placement as follows.
1 . Signs, not to exceed 4tx 8' ; in size, on
the entrance gates, and the immediate approaches
to those gates, to Foxfield' s property and placed
in such a manner so as not to obstruct the vision
or movement of vehicular traffic. These signs are
to be directional and instructional, not advertising,
in nature. Placement will be on the Foxfield property
side of the roadway and on the border of the highway
right of way.
2. Two'no-thoroughfare signs to be placed at
the enterance of 2 private drives immediately across
the roadway from the Foxfield property for the
purpose of protecting neighboring private property
from trespass on the day of a scheduled event at
Foxfield. These would be put up on the morning of
the event and removed the following morning.
3. One sign directly across the roadway from
the west entrance gate to Foxfield signifying as
follows: "Horse vans turn left at next gateway".
Sign not to be larger than 3' x 4 . Placement will
be such that there will be no obstruction to vision
or movement of vehicular traffic.

4. Directional signs sized 10" x 14" for
placement on highway approach routes to Foxfield.
property. These include the words "Foxfield Races"
and a directional arrow. The signs would be placed
at appropiate turnoffs, intersections and junctions
on state and countyLroad ways within an 8 to 10
mile radius around the Foxfield. property. These signs
are intended and. have served on two past occasions
to aid and facilitate traffic flow on the day of
an event at Foxfield. The signs would be placed 24
hours prior to the event and removed within 48 hours
following the event. The purpose of these signs has
been to encourage persons en route to a Foxfield
event to use alternate routes if possible and thus
minimize excess traffic flow on Garth and Barracks
Road. It has been indicated by area police officials
that these signs were in fact helpful toward that

purpose.
