HomeMy WebLinkAboutSUB201900039 Review Comments Final Plat 2019-04-30 1 County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 434-296-5832 Memorandum To: Christopher Kean From: Christopher Perez, Senior Planner Division: Planning Date: April 30, 2019 Subject: SUB201900039 Briarwood - Phase 8 - Final Subdivision Plat The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [ZMA2004-14, ZMA2005-9] Proffer 11 – Affordable Housing. Eight (8) affordable units are required in phase 8. Depict and label these units on the final plat. The minor amendment was recently revised to list Lots 112-119 as affordable units. Please mark these units on the plat as such and provide a note on the cover sheet of the plat documenting this. 2. [14-303(A), 14-302(A)1, 4, & 5] Easements. Portions of the new private storm drainage easements and other easements (private access easements) are located on the adjacent lot TMP 32G-B, which is also owned by Briarwood Associates. Staff believes the offsite portions of these easements are already recorded in the Clerk’s office, if this is the case on the plat depict, label and provide Deed Book Page Reference information for these offsite easements. I believe they can be found in: DB 3833 PG 247 (with the plat being depicted on DB 3833 PG 256). If this is not the case and the plat under review attempts to plat these offsite portions of the easements, revise plat information to include all required information to include TMP 32G-B and the new offsite easements. Including a signature line and notary for the adjacent owner. 3. [14-303(E)] Throughout the plat label Elm Tree Court as a “private street easement”. If you prefer you may continue to label Elm Tree Court as “variable width private access easement”, but you must also label it as a “private street easement”, as this is how each lot is gaining its frontage. Please ensure it is labeled as such on all sheets. 4. [14-302(B)(1)] General information. Provide the date of the last revision on the plat. 5. [14-311] Infrastructure improvement plans. Prior to final plat approval the private street shall be built or bonded. Engineering offers the following comment: “The remaining road bond for Elm Tree Court will need to be posted prior to plat approval.” 6. [County Attorney Review of Legal Documents, 14-317] The proposed property description in the Eleventh Supplemental Declaration does not seem to match the plat that you provided. Specifically, I’m not seeing a 4/5/2019 date on the plat. Let me know if I’m missing something. Otherwise, I’d suggest the following property description: “All that land shown on that certain plat of Lincoln Surveying entitled “Subdivision Plat Showing Lots 17 Through 39, Lots 112 Through 127, Lots 129 Through 134, Revising Lots 109-111, Phase 8, Briarwood Subdivision, Rio Magisterial District, Albemarle County, Virginia,” dated March 7, 2019, revised March 13, 2019, recorded herewith and made a part hereof.” Ensure the last revised date referenced in the legal documents matches the last revised date of the plat. 2 Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney’s office. The Code may found on the County Attorney’s website which may be found under “Departments and Services” at Albemarle.org. In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
