Raney 530 East Main Street Charlottesville, VA 22902 RE: LZC201900008 - Parcel ID 056A3-00-00-00900 (2.32 Acres), 5370 Three Notch'd Rd, 5368 Three Notch'd Rd, and 5380 Three Notch'd Rd, Crozet, VA 22932 (the "Property"), Owner — Notch'd LLC 90 Stockton Ridge PI, Greenwood, VA 22943 Mr. Raney: In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following: The Property is zoned Planned Development -Shopping Center (PD-SC) per Zoning Map Amendment ZMA2007-00006, approved December 12, 2007 with proffers. The associated application plan was subsequently amended by Zoning Map Amendment ZMA2011-00008, approved May 2, 2012 with proffers. The permitted uses of the Property, except those otherwise prohibited in the proffers, are provided in Section 25 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to the Entrance Corridor Overlay District as described in Section 30 of the Zoning Ordinance. The Property is subject to Site Development Plan SDP2008-00179, approved October 27, 2009 as well as a Minor Site Plan Amendment SDP2013-00229, approved March 13, 2014. Under current State law ($ 15.2-2209.1. Extension of approvals to address housing crisis.) SDP2008-00179 remains a valid site plan until July 1, 2020. The Property was inspected for Zoning Compliance on April 30, 2019. The Property appeared to be under construction and has been somewhat developed in accordance with the approved site plans. There was one potential violation associated with the Property and the Current Uses. Behind the existing structure there is an accessory structure that does not appear on any site plan (see attached picture). This unpermitted structure if it remains permanent would be considered a Zoning Violation. However, at this time there are no outstanding building or zoning violations on file. • There are no additional Special Use Permits, Rezonings, or Variances associated with the Property and none are currently pending. • All requirements of the Zoning Ordinance related to ingress and egress from the Property to a public street have been satisfied at the time being. The Property's ingress and egress has not been developed in accord with the approved site plans, but it is not a violation while the Property is being phased. May 2, 2019 LZC2019-00008 Page 2 • There are no special conditions or time constraints applicable to or imposed on the Property for the Current Uses. • There are no proceedings, pending or threatened, to revoke, rescind, alter, or declare invalid any laws, ordinances, codes, approvals, permits or certificates applicable to or issued in connection with the Property by the County. • Copies of any applicable records may be obtained via the noted links or from this office with a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(o-)-albemarle.org once they have been approved or issued.
