Dear Mr. Greene,
The LOR application referenced above has been reviewed. In order for the amended site plan to be
approved the following revisions are required:
[Comment] Application. There has been a LOR to this site plan previously (approved December 9, 2013).
Please update the application materials to reflect that this is the second LOR. Rev. 1: Comment
addressed.
2. [32.5.2(a)] Special Use Permit. On the Cover Sheet, please provide a note referencing the special use
permit associated with this LOR as well as the conditions attached to the permit (see attached list of
conditions for reference). Rev. 1: The conditions for SP201800022 have been amended since this LOR
was last submitted. Please update the Special Use Permit Conditions note to include ALL of the
conditions of the special use permit, as written and approved by the Board of Supervisors on May 1,
2019. A copy of these conditions is attached.
3. 132.5.2(a), SP2018000221 Conditions. Proposed Condition #3 of the special use permit requires proposed
landscape elements located in the stormwater easement to be comprised of species on the County approved
plant list. The proposed "Ilex meserveae" species does not appear to be on this list. Please review and
revise the planting schedule accordingly. Rev. 1: This comment is being withdrawn from the planning -
related comments. Planning reviewer will instead defer to ARB-related review comments.
4. [Comment] Landscaping Plan. It appears not all of the original landscaping elements, as approved in the
original site plan, are reflected in the revised landscaping plan on Sheet S6. Specifically, shrubs
surrounding Buildings A and B seem to be left off. Please include those elements on the submitted
landscaping plan (see attached excerpt from 2010 site plan for reference). Rev. 1: Ask discussed during
our call, please reflect the following departures from the previous approved site plan (see attached
excerpt from the approved site plan):
a. Depict the removal of all three ICST bushes on the northeast corner of the Building A, and
b. Since there has been a change to the parking area of Schewel's Furniture, that change will
need to be included as part of this LOR, before this LOR can be approved. This will require:
i. Reflecting in the LOR request and materials the removal of two (2) parking spaces
at the building entrance and subsequent creation of two (2) parking spaces in the
row of parking fronting Route 29.
ii. Amending the landscaping plan of the parking area to show where new plantings
are located. Note: If trees have been removed, replacement plantings may be needed
to meet County requirements.
5. 132.6.2(k), 4.171 Outdoor Lighting. The information panels for Proposed Light Fixture "D" were illegible.
Please submit higher resolution images so this information can be read and evaluated against the County
ordinances. Rev. 1: Comment addressed.
6. [Comment] Signature Block. Please remove the signature block on the Cover Sheet. It is not needed for a
LOR (LORs are typically only signed by the lead planner). Rev. 1: Comment addressed.
7. [Comment] Check spelling in notes/labels on Sheets S4 and S7. Revise as necessary. Rev. 1: Comment
addressed.
8. [Comment] The special use permit associated with this LOR, SP201800022, will need to be approved
before this LOR can be granted approval by the County. Rev. 1: SP201800022 was approved by the
Albemarle County Board of Supervisors on May 1, 2019. Therefore, this application can be approved
once all review comments are addressed to the satisfaction of the plan reviewers.

SP-2018-22 Dogtopia
Special Use Permit Conditions
1. Development of the use shall be in general accord with the conceptual plan titled "Dogtopia" prepared by
RJA Architect and Roudabush, Gale & Associates, with the latest revision date of 2/4/2019, as
determined by the Director of Planning and the Zoning Administrator. To be in general accord with the
Conceptual Plan, development shall reflect the following major elements within the development
essential to the design of the development:
Location of outdoor play area and fence as shown on the plan.
Minor modifications to the plan which do not conflict with the elements above may be made to ensure
compliance with the Zoning Ordinance.
2. Outdoor play hours shall be restricted to no earlier than 8am and no later than 7pm.
The proposed landscaping within the stormwater drainage easement will be limited to shrubs and small
trees (as listed in the County approved plant list). No medium or large tree(s) shall be planted within the
easement.
4. Prior to the issuance of a building permit, the applicant must submit information to the satisfaction of the
County Engineer and the Zoning Administrator (or their designees) that demonstrates the proposed use
will not exceed a 65-decibel maximum as measured in any adjacent commercial space in accord with
County Code 18-4.18-04.
5. A parking study shall be provided by the applicant, subject to approval by the Zoning Administrator, to
confirm that there are a sufficient number of spaces on site and to ensure there are no parking conflicts
with other shopping center tenants when more than the seven allotted parking spaces are needed, prior to
the approval of the site plan amendment.
6. The fence shall not conceal any part of the triple window on the southeast corner of the building or either
of the 2 easterly brick piers.
7. The fence material and detailing are subject to ARB review. An 8-foot-tall fence shall have only bottom
and top rails (no intermediate rails). The fence color shall be coordinated with the existing building
colors and is subject to ARB approval.
8. Landscaping shall be provided on the east and south sides of the fence to the satisfaction of the ARB.
9. No tinted or reflective films or similar materials shall be applied to windows visible from the Entrance
Corridor. Window glass visible from the Entrance Corridor shall remain transparent.
