Sec. 14-221 Deferral of review of preliminary plat; when application deemed withdrawn. The review of,and action on,a preliminary plat may be deferred,and an application for a preliminary plat may be deemed withdrawn,as follows: A. Request to defer by subdivider.A subdivider may request that review or action on its application for a preliminary plat be deferred for a specified period up to six(6)months. If during the deferral period the subdivider does not request the agent to take action on the preliminary plat as provided in section 14-222 within six (6)months after the date the deferral was requested,the application shall be deemed to have been voluntarily withdrawn. B. Failure to submit revised plat. If a subdivider fails to submit a revised preliminary plat to address all of the requirements within six(6)months after the date of the letter from the agent as provided in section 14-220,the application shall be deemed to have been voluntarily withdrawn by the subdivider. (Tax Map 36 - Parcel 20) The County of Albemarle Division of Zoning and Current Development is denying the subdivision plat referred to above. Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified. A) The subdivision plat referred to above does not meet the definition of a Rural Subdivision. [Section 14-106] Definitions. Rural subdivision. The term"rural subdivision"means a type of subdivision that is located in the rural areas which results in two or more lots for the purpose of transfer of ownership or building development, such that: (i) each lot created is at least five (5) acres in area; and(ii) each lot created has at least two hundred fifty(250) feet of frontage on an existing public street which is part of the primary system or secondary system of state highways. B) The subdivision has a private street as its principle means of access. The private street serves 6 or more lots. The private street has to meet standards set forth in section 14-412 (seen item C below). [Section 14.410.F] Principal means of access to subdivision. The principal means of access to a subdivision shall be either a public street or a private street. The principal means of access shall conform, in the case of a public street,to Virginia Department of Transportation standards, or, in the case of a private street, to the standards of the county as set forth in section 14-412,throughout the street's length, including any distance between the boundary of the subdivision and any existing public street. C)Albemarle County requires Private Streets serving 6 or more lots to meet the Virginia Department of Transportation Standards. [Section 14-412.3] Streets serving six lots or more. "Each private street serving six(6) or more lots shall satisfy Virginia Department of Transportation standards." 1
