Applicant requests relief from section 18-3-1 of the Albemarle County
Zoning Ordinance to allow a free-standing business sign to be located
near the right-of-way of Route 250 West, a scenic highway.
Zoning Ordinance Requirements
No structure, except as hereinafter provided in the case of certain signs,
shall be constructed within one hundred fifty (150) feet of the right-of-
way of any designated scenic highway or Virginia byway having a right-of-
way width of fifty (50) feet or more, nor within one hundred seventy-five
feet (175) of the right-of-way of any such highway or byway having a right-
of-way width of less than fifty (50) feet.
Staff Recommendation
The applicant's land sits in a hollow off of Route 250. The topographic
conditions are very steep until one is near the applicant's building.
Since this is a sign variance for setback, the type of sign and its
character are important to the purpose of the scenic highway designation.
The ordinance sets out specific provisions and procedures for approval
of the character of the sign. However, the BZA is not restricted from
considering conditions of approval to include the make up of the
sign. The scenic sign provisions encourage wood structures with a
pleasing appearance.
The Staff would not recommend a 150 foot variance, but rather a setback that
is feasible to allow the public to see the sign and yet obtain the greatest
setback feasible. The applicant is restricted by height limitations also.
The applicant's next door neighbor has a nonconforming sign pre-dating the
scenic highway ordinance.
If the Board chooses to approve the variance, staff recommends that the
sign be landscaped to the approval of the Planning Department. The applicant
must also submit his proposal in design to the Director of Planning for
approval.
