(VA-79-21) It will be very helpful to the Board of Zoning Appeals to submit a diagram of the store location and surrounding area. We require also a diagram of the signs, locations, and true dimensions to scale. If you would forward these submittals forthwith, it would be appreciated in order to enclose them with the staff reports for the Board of Zoning Appeals. I went ahead to seek a fine on the violation. New York Carpet World of Virginia, A Virginia Corporation Tax Map: 78 Parcel: 5F Zoned: B-1 Existing Activity Carpet Store Proposed Variance The applicant requests relief from section 15A-6-2(6) of the Albemarle County Zoning Ordinance to allow a wall sign of 476 square feet; a variance of 449 square feet. Zoning Ordinance Requirements Business Signs: Wall: Provided: (a) if illuminated, no moving, flashing, blinking, color-changing, or exposed, bare or uncovered neon illumination, or lighting; (b) the aggregate area of all such signs shall not exceed two hundred (200) square feet; (c) no portion of such sign shall be greater than thirty (30) feet from ground level or the eave line of the roof of the main building located on the premises upon which such sign is erected, whichever is greater. Staff Recommendations The sign was emplaced intentionally and in violation of the Zoning Ordinance. The staff must argue there is no hardship. The staff recommends disapproval. Staff Recommendation The applicant is proposing the removal of non-conforming sign that he would otherwise have the right to use since the existing signs are non-conforming. Staff notes the applicant ' s investment and good maintenance of his existing sign and that he proposes to constrict the area of the sign by redesign. No expansion of the sign is proposed. He will meet all other sign requirements .
