Sec. 14-221 Deferral of review of preliminary plat; when application deemed withdrawn. The review of,and action on,a preliminary plat may be deferred,and an application for a preliminary plat may be deemed withdrawn,as follows: A. Request to defer by subdivider.A subdivider may request that review or action on its application for a preliminary plat be deferred for a specified period up to six(6)months. If during the deferral period the subdivider does not request the agent to take action on the preliminary plat as provided in section 14-222 within six(6)months after the date the deferral was requested,the application shall be deemed to have been voluntarily withdrawn. B. Failure to submit revised plat. If a subdivider fails to submit a revised preliminary plat to address all of the requirements within six(6)months after the date of the letter from the agent as provided in section 14-220,the application shall be deemed to have been voluntarily withdrawn by the subdivider. Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified. 1. The subdivision plat referred to above does not meet requirements for final plat approval. The Albemarle County Planning Commission at its meeting on October 24th 2006 approved SUB2006-204, SUB2006-205 and SUB2006-206 (Woodridge Phases A,B and C) with conditions: A) Comment from Josh Rubinstein (Groundwater Manager):This subdivision covers three different existing parcels. Each parcel should be covered by its own application. Once the applicant submits a plat covering a single existing parcel, the Groundwater Assessment fees already paid can be applied to that application. B) The final Rural Preservation Development plat does not meet all approval conditions set forth by the Planning Commission on October 24th 2006. Phases A, B, and C were approved with the condition that the final application be brought before the Planning Commission accompanied by groundwater testing for approval. The groundwater manager has asked for changes, and the final plat cannot be presented as shown to the Planning Commission. I have attached the Planning Commission approval letters for Woodridge Phases A, B and C.
