Tax Map: 60A Parcels: 2 & 3 Zoned: R-1 Existing Activity Parcel 2 - Vacant Parcel 3 - Single-Family Dwelling Proposed Variance The applicant requests relief from section 4-2-2 of the Albemarle County Zoning Ordinance to allow a dwelling to be on a (to be subdivided) lot of less than 40,000 square feet in order to correct structure encroachment over existing property lines. Subdivision approval is reserved for the County Planning Commission. The house on parcel 3 encroaches onto Parcel 2. The request is for exchange of land approval will allow Mrs. Ross to have her home located entirely on property owner by her (parcel B) . Parcel C is to be added to Mowinkel property and Parcel A will be added to tract I of the Mowinkel property. Bennington Woods, Inc. retains the right of first refusal to purchase Parcel B. Zoning Ordinance Requirements 4-2-2 Residential developments served by either a central sewer system or a central wzter supply shall provide a minimum area of forty thousand (40,000) square feet per dwelling unit. (Amended 12-14-77) Staff Recommendations �t��t_, k-c li The applicants are faced with an unusual si_tuationeingbuilt on another person's property. The hardship being declared is the cost to relocate the home and the present trespass. The variance concerns area requirements. (i.e. 40,000 square feet per dwelling unit and allowing this variance will cause one non-conforming lot to be less than it is now in square feet and the other to be larger than it is now. However, neither will be 40,000 square feet.) The applicants propose shifting of the property line to correct the problem and indoing so will made one non-conforming lot less non-conforming and the other non-conforming lot will become less non-conforming. Considering the depreciable difference in lot areas, the same zoning for each lot, staff recommends approval subject to: 1) Plat of record be made, recorded, and a copy to Planning and Zoning Departments. 2) Hook up to all public utilities in the event well or septic fall into disrepair.
