Use of Existing Buildings at
Intersection of Rt. 250 & Rt. 810
Dear Fred:
Presently, the above site is zoned B-1 and is composed of two legal
tax map parcels totaling .5 and 1.07 acres, respectively. There are
several buildings on this site which have been used for a variety of uses
in the last fifty years.
The owner has done interior renovations and has emplaced in these
buildings of late a pizza shop, a gun shop, a CPA office, a dentist office,
and recently a rug cleaning business. The pizza shop and gun shop are
open evenings only. The CPA, dentist, and rug cleaning business are ope
normal working hours. The CPA is leaving and Dr. Buckle, a veterinarian
plans to seek a special use permit for a veterinarian office and field
examination use in the B-i zone.
The present site is served by public water and several septic systems
which are working. To date, parking has been adequate although if one or
more small businesses are to locate on the site to operate normal hours, ;
additional parking will be required and that will require a site plan.
The questions which have arisen come from section 7-2 which requires
40,000 square feet per business establishment when the lot is served by
either a public water or public sewer but not both. We are trying to advise
Mr. Rauch whether he would need a variance or not on each legal parcel in
order to have the shops and businesses that he has or proposes if 40,000
square feet is required for each and every business regardless of size. ,
(Most offices and businesses are in spaces less than 300 square feet. )

This question has come up before for existing lots and buildings
when one tenant changes, but we have not had the situation where existing
buildings are renovated to allow for more than one business establishment.
The owner's argument is section 7-2 does not apply to them and that existing
septic systems are adequate. If section 7-2 does apply, then they wish to
seek a variance. (The types of shops and businesses do not have a heavy
sewerage use; therefore, they feel 40,000square feet should not apply.)

Existing Activity
Farm-home business which has been in operation at the same location for
51 years. During this period small equipment, large equipment, lawn mowers,
gasoline pumps and related machines have been 'sold and serviced and repaired
on premises.
Fruit Growers comprises nine (9) buildings located at the intersection of
Route 810 and 240. It is planned to rent as much frontage as possible for
offices, small shops and the small equipment service building which has been
rented to John Barbour.
Proposed Variance
The applicant requests relief from section 7-2 of the Albemarle County Zoning
Ordinance to allow new businesses to be added to the Co-Op.
Zoning Ordinance Requirements
There shall be no minimum area requirements for permitted uses, except as
herein otherwise expressly provided. In the case of any parcel served by
either a central sewer system or a central water supply, there shall be
provided a minimum area of forty thousand (40,000) square feet per commercial
or industrial establishment or per dwelling unit, as the case may be.

concerning the zoning use of the buildings owned by the Fruit Growers
Cooperative in Crozet.
I wish to propose a meeting with you on March 1, 1978, Wednesday at
2:00 p.m. at which time we can discuss the zoning regulations that may
or may not pertain to the Fruit Growers Cooperative. I will be more than
willing to discuss as well as explain the requirements of the county's
zoning ordinance and to assist you in any proper way that I can.

Several weeks ago I discussed with you the situation of zoning at
Fruit Growers Cooperative in Crozet. We are a farm/home business which
has been in operation at the same location for the past 51 years.
During this period small equipment, large equipment, lawn mowers, gasoline
pumps and related machines have been sold and serviced and repaired on
premises.
Fruit Growers comprises nine (9) buildings located at the intersection
of Routes 810 and 240. It is our plan to rent as much frontage as we
can spare for offices, small shops and, of course, the small equipment
service building which has been rented to John Barbour.
I am most anxious to have you come out and look over our situation so
that when people apply for business permits you will be familiar with our
situation. If you will just call me the day before you come so I will be
available to show you the premises, I would appreciate it.

This will acknowledge receipt of yours of May 9, 1979 .
As I understand the situation you have in mind, there is a
site in downtown Crozet, consisting of 1. 57 acres in two
separate parcels which have been used for business in the
past. As I understand it, up until recent times this property
has been occupied by the Fruit Growers Co-Op and one other
business. In recent years , an additional five businesses
have occupied these buildings.
It is my opinion that, while the businesses which were
located on the site prior to December of 1977 , may be non-
conforming as to the lot size, any subsequent additions must
be made to comply with the ordinance. Since there has been
at least one recent addition according to your letter, it is
my opinion that this situation violates the ordinance and
that, with public water available, the total occupancy
should be based on the number of establishments times 40 , 000
square feet.
If you have any further questions, please let me know.
