Staff Recommendation 26 July 1979 Board of Zoning Appeals COUNTY OF ALBEMARLE 414 East Market Street Charlottesville, Vir 'inia Re: Action VA-79-35 Gentlemen: The letter which I received yesterday simply said my request for variance was denied, giving no reason and referring incorrectly to the proposed building as a garage/workshop. It is indeed a small carefully designed workshop and storage with only a single car carport. Since the letter did not address the criteria in our request which clearly identified that as the only usable site, and since our neighbors approved and joined in our request we are quite nat- urally bewildered. In order to get under roof before bad weather I am obliged to enter contracts for the site preparation to begin in September. Because we must remain here to look after my wife' s blind mother until September 15th, I am unable to come in and talk this over with you. Hating no basement, this is not a viable home without space for projects and tool storage . For all the reasons given in our request this is the only site which would offer any possibiilit of eventually recovering the considerable investment required to build the addition. Since our frontage is on a large circle, any addition would be closer to the road - on the side - than the original structure . Because we are under a hill an addition in line with the original structure would increase already severe drainage problems which we have spent great effort correcting. Your thoughtful response, your reconsideration and your ap- proval of this variance is urgently and respectfully requested and will be deeply appreciated. Most of all I regret that the information furnished in my submission for a variance did not provide a sufficiently clear picture for the Board to understand the factors involved which made the particular site the only feasible choice . Obviously I should be present at the hearing to furnish further clarification. Since I cannot returiiltocCharlottesville until the middle of September I would like permission to address the October 10th meeting of the Appeal Board. I hope that before that meeting you and/or one of the Board members would be kind enough to meet with me at the site to give you a first-hand. knowledge of the problems involved. Placing the workshop/carport in line with the existing house would seriously devalue my property ( and blight the area) rather than add to it . It would block one end of the small house cutting off light and essential ventilatiOn4 as well as the view, to both bedrooms . It would block and make almost inaccessible the rear entrance to the house . It would require considerable excavation and loss of trees - including an unusually large and beautiful dogwood. As we are under a hill, it would add severe drainage problems to already existing ones which we are present- ly trying to overcome . We have spent much time, thought and consultation in selecting a site for the workshop/carport which would enhance the value of our property and be suitable in the neighborhood. My letter of July 17, 1979 stated that the garage can be placed in line with the existing house and meet the required 75 foot setback. As for the incorrect wording of garage/workshop, your application signed by you stated that "The applicant requests relief from section 2-3 to allow a garage/workshop to be located 23 feet from the property line, a variance of 52 square feet. " The Board of Zoning Appeals felt like that this was not a hardship case and therefore, denied the variance. The staff recommendation was that this was not a hardship case, because the structure could be located on the parcel and still maintain the seventy-five foot (75' ) setback.' If you have additional information that was not presented at the meeting, please do so. The Board of Zoning Appeals can hear this again at the September 11, 1979 meeting if they vote to suspend the rule at the meeting. However, you will have to re-apply for the variance August 13, 1979Niftwol err Perry Ford Page 2. and pay a $20.00 fee. If they do not vote to suspend the rule, then this cannot be heard again for one year from the date the variance was denied. Please let me have your reply by August 27, 1979 so this can be brought up with the Board of Zoning Appeals on September 11, 1979. The side nearest the road is approximately 23 feet within my pro- perty line, which is on a curve . Mr. Shaw, of your office, measured the corners of the proposed roof to be 52feet and 48 feet from the center of the road at that nearest point . The road is 18 feet wide and paved with a shoulder and drainage ditch on each side . The road is a one mile circle ; each lot on this circle contains about 3 acres . This workshop is essential for continued maintenance and im- provement of our home which has no basement or storage area for tools or equipment. I am retired. Since purchasing this home I have spent most of my time and savings in efforts to im- prove its integrity and make it a pleasant and livable property. Thorough investigation has resulted in the designated site as the only choice for the following reasons : . It is the best match to the difficult slopes of the land. . It allows the preservation of the woods and natural growth. . It permits required drainage around the new building without adding to the existing drainage problems around the main house which I am in process of correcting. . It is close enough to the house for quick access yet will not obstruct the view. . It does not interfere with the buried oil tank, septic field or driven well . . It can be attached to the house by a decorative fence and arch thus more aesthetically pleasing. We expect to spend our summer in Nova Scotia so that my wife can help her mother who is blind. We expect to leave on the 19th of June and return the 14th of September. Not knowing that a variance would be required I had already made arrangements to begin the project before leaving. I learned from Mr. Shaw that the procedure for obtaining a variance will make this impossible . I have already obtained the approval and agreement of my near- by neighbors and their signatures are attached herewith. We will be very appreciative if you will grant this variance and permission to build, in our absence , so that work can pro- ceed 'as soon as we return. Costs seems to esc late d ily . Elmer V.
