George Carter Tax Map: 59 Parcel: 23 Zoned: B-1 Existing Activity Commercial Nursery Proposed Variance The applicant requests relief from section 18-3-5 (b) 1 to allow a free- standing sign to be higher than 10 feet or a variance not greater than 30 feet from ground level and relief from section 18-3-1 of the Albemarle County Ordinance to allow a sign to be located near the right-of-way; a variance of 150 feet. Zoning Ordinance Requirements • 18-3-5(b)1: Business Signs (free-standing or projecting) : One (1) free- standing sign or one (1) �crojecting sign per establishment per road frontage. Each sign shall not exceed eighteen (18) square feet in area nor exceed ten (1) feet in height above around level, with lesser heights being encouraged. 18-3-1: No structure, except as hereinafter provided in the case of certain signs, shall be constructed with one hundred fifty (150) feet of the right- of-way of any designated scenic highway or Virginia byway having a right-of- way width of fifty (50) feet or more, nor within one hundred seventy-five (175) feet of the right-of-way of any such highway or byway having a right- of-way width of less than fifty (50) feet. Staff Recommendation Because of the steep topography of the area, it is impossible to install the sign 150 feet off the right-of-way. The only suitable area would be near the right-of-way of Route 250. Presently, the business is screened from Route 250 west by large trees which is in keeping with the intent of the scenic highway. Staff recommends approval because of the topographic hardship.
