Daniel McClure 104 Roslyn Hills Drive Richmond, VA 23229 E: Board of Zoning Appeals Action VA-79-50 Dear Mr. McClure: This letter is in reference to the above variance denied by the Board of Zoning Appeals at their meeting August 28, 1979. The reason for this denial was that all three members did not vote to grant this variance as set forth in section 12.1-5.2 of the Albemarle County Zoning Ordinance. The concurring vote of three members shall be necessary to grant a variance. Since one member abstained from the vote, the variance was denied. It will not be necessary for you to appear at the next meeting of the Board of Zoning Appeals. The Zoning Administrator will take this matter up with the Board at the meeting to be held September 11, 1979. The Board will then vote on a re-hearing to be held October 9, 1979. If they choose to hear the application again, you must submit to our office a new application and fee since it must be re-advertised and adjacent property owners notified. As you see, he informs me that the vote of the Board on August 28, 1979 was invalid because one gentlemen abstained. I would like to follow David' s suggestion and ask the Board to reconsider its vote on the existing record, with- out the necessity of another trip to Charlottesville. What would you suggest? McClure, III, Esquire Mays, Valentine, Davenport & Moore Post Office Box 1122 Richmond, VA 23208 Re: Block to McClure Dear Bill: Enclosed herewith is a copy of Section 12 .1-5. 2 of the Albemarle County Code, which deals with procedure before the Board of Zoning Appeals. You will note that the final sentence of this provision requires the concurring vote of three members of the Board of Zoning Appeals in order to effect any variance from the Zoning Ordinance. The purported approval of your it request for a variance was apparently invalid. To save yourself the time and expense of another trip to Charlottesville, you should consider making a letter request to the Board of Zoning Appeals to reconsider your application for a variance on the existing record. If you think it might be helpful, we would be happy to suggest to Mr. Block that he write a letter to the Board of Zoning Appeals endorsing your application for a variance and urging approval. { Please let me know if we can be of any assistance to you. Block s j • %krw✓ - '.1-4 APPLICATION FOR VARIANCES Application for variances may be made by any prop- erty owner, tenant, government official , department, board or bureau. Such application shall be made to . the zoning administrator in accordance with the pro- visions of this article and with rules adopted by the board. The application and accompanying maps , plans or other information shall be transmitted promptly to the secretary of the board who shall place the matter } on the docket to be acted on by the board . No such 1 $ variance shall be authorized except after notice and I hearing as required by Section 15. 1-431 of the Code. .: The zoning administrator shall also transmit a copy s of the application to the commission which may send a recommendation to the board or appear as a party i li at the hearing. ; 2J-5 PROCEDURE 2.1-5. 1 Appeals and applications for variances shall be filed ''' with the zoning administrator, together with a fee of twenty dollars ($20. 00) to cover the cost of the pro- cessing of such appeal or application. 2.1-5. 2 The board shall fix a reasonable time for the hearing of an application or appeal, give public notice there- of pursuant to Section 15 . 1-431 of the Code, as well as due notice to the parties in interest, and decide the same within sixty (60) days . In exercising its ' powers, the board may reverse or affirm, wholly or partly, or may modify the order, requirement, decision, I or determination appealed from. The concurring vote of three (3) members shall be necessary to reverse i # any order, requirement, decision, or determination ' i ; of an administrative officer or to decide in favor of the applicant on any matter upon which it is re- quired to pass under the ordinance or to effect any variance from this ordinance. "2'1-6 DECISION OF BOARD OF ZONING APPEALS Any person or persons jointly or severally aggrieved by any decision of the board of zoing 'appeals , or any taxpayer or any officer, department, board, or bureau of the county may present to the circuit court of the county a petition specifying the grounds on which aggrieved within thirty (30) days after the filing of the decision in the office of the board , which . petition shall proceed in accordance with Section 15 . 1-497 of the Code. 88 a. STAFF REPORT VA-79-50. W. G. McClure, Jr. and F. Daniel McClure Tax Map: 87A Parcel: 23 Zoned: A-1 Existing Activity Single-family residence Proposed Variance The applicants request relief from the following sections: (1) Section 2-5-1 to allow the east property side to be 9 feet; a vari- ance of 16 feet; and (2) Section 2-6-2 to allow the west property side fronting on Rte. 711 to be 26 feet; a variance of 4 feet. Zoning Ordinance Requirements (1) Section 2-5-1 Side. The minimum side yard for each main structure shall be twenty-five (25) feet or more. (2) Section 2-6-2 The side yard on the side facing the side street shall be thirty (30) feet or more for both main and accessory buildings. Staff Recommendation Staff recommends denial because the property lines were staked and inspected by the Zoning Inspector and viewed by the contractor and owner. The house was then correct by the original survey. A new survey had to be made when the house was put under contract. After the new survey was completed, the property lines were re-located too close to the house. Staff feels this was no fault of the inspector but the surveyor.
