Valerie Lee Bryant Tax Map: 45 Parcel: 19B Zoned: A-1 Existing Activity Single-family residence Proposed Variance The applicant requests relief from section 2-3 of the Albemarle County Zoning Ordinance to allow the house to be located at 27.8 feet from the front property line; a variance of 47.2 feet and section 2-5-1 of the Albemarle County Zoning Ordinance to allow the house to be located 18.7 feet from the side property line; a variance of 6.3 feet. Zoning Ordinance Requirements Section 2-3: All structures, as herein specifically defined, shall be located a minimum of seventy-five (75) feet from any street, road, or access easement. For purposes of this section only, the term "structures" shall not be deemed to include on-site signs for sale or rental of property, shelters designed and used by school children traveling to and from school, or structures, other than signs, for which no permit is required under the Uniform Statewide Building Code. (Amended 10-20-76) Section 2-5-1: Side. The minimum side yard for each main structure shall be twenty-five (25) feet or more. Staff Recommendation This variance is needed because a mistake was made when the house was built. Another survey had to be made in order to sell the house. The mistake was found at this time. The house should have been 30 feet back (the setback requirement at that time) , but is only 27.8 feet I i back. The setback is not 75 feet and in order to obtain a loan, a variance is needed. I i !
