Sec. 14-221 Deferral of review of preliminary plat;when application deemed withdrawn. The review of,and action on,a preliminary plat may be deferred,and an application for a preliminary plat may be deemed withdrawn,as follows: A. Request to defer by subdivider. A subdivider may request that review or action on its application for a preliminary plat be deferred for a specified period up to six(6)months. If during the deferral period the subdivider does not request the agent to take action on the preliminary plat as provided in section 14-222 within six(6)months after the date the deferral was requested,the application shall be deemed to have been voluntarily withdrawn. B. Failure to submit revised plat. If a subdivider fails to submit a revised preliminary plat to address all of the requirements within six(6)months after the date of the letter from the agent as provided in section 14-220,the application shall be deemed to have been voluntarily withdrawn by the subdivider. Box 730 Crozet, VA 22932 RE: Proposed Easement to provide for Sidewalk Maintenance in Bargamin Park Dear Mr. Katcham I have reviewed the draft titled, "THIRD AMENDMENT TO COVENENTS, CONDITIONS AND RESTRICTIONS AFFECTING ALL LOTS IN BARGAMIN PARK SUBDIVISION." I have also discussed this with the County Attorney, Greg Cooley, an engineer in our Inspections Division and Joel DeNunzio of VDOT I offer these comments. It is now my understanding that VDOT is willing to accept responsibility for the maintenance of the sidewalk if the owners grant VDOT an easement to allow it to do so. This is on the condition that it be specified in the easement that VDOT shall not be responsible for clearing snow from the walk. Alternatively, I understand that VDOT is willing to accept a portion of the sidewalk in the right of way if the Home Owners' Association makes an agreement with VDOT to maintain the portion of the sidewalk in the right of way. The pending draft amendment to the covenants that you have submitted adds sidewalks to Article V, Section 2 "Purpose of Dues and Assessments." If you choose to pursue either of these options this document must be amended to clarify the maintenance responsibilities of the homeowners association and VDOT. I recommend you request a sample agreement from VDOT. Other sections of the original covenants may also need to be revised. Section IV F gives the association the right to grant easements to public agencies. A provision to make clear that an easement over a sidewalk located on a private lot can be established for the sidewalks may need to be added here as well. Section VI provides for maintenance on private roads.
